Sikh Political prisoner, Devinderpal Singh Bhullar was on Monday acquitted in a 1992 Terrorists and Disruptive Activities (Prevention) Act (TADA) case registered against him at the Batala Sadar police station. Charges under section 307 (attempt to murder) of the Indian Penal Code, Arms Act and the Explosives Act were also slapped on Bhullar in the case that pertains to an encounter after a police party was ambushed by a group of militants. The designated TADA court of Surinder Singh which heard the case, dismissed the chargesheet filed by the Batala police and discharged Bhullar for want of evidence. The court accepted the plea of Bhullar’s counsel that there was no direct evidence to suggest his client’s involvement and neither were there any witnesses in the case. The chargesheet was filed by police in February and the former militant was granted bail by the TADA court in March in the case. The verdict by the designated TADA court will pave the way for Bhullar to apply for parole that was denied to him as he had not been acquitted in the Batala case. Bhullar can now move an application before the government seeking parole. He has remained behind bars since his deportation to India in 1995 followed by his arrest in a blast case. Bhullar had already sought parole after he was granted bail in the case on March 3 on surety bond of Rs 50,000. Bhavandeep Singh Sidhu of the United Akali Dal and Bapu Surat Singh Khalsa Sangharsh Committee welcomed the verdict by the court. “We expect Prof. Bhullar to be released from jail within a few days now,” he said. “This will allow Prof. Bhullar to apply for parole, however we hope that the 1993 case against him by Maninderjeet Bittu does not cause hurdles,” he added. Despite his acquittal in the TADA case, Bhullar will continue to remain under detention for his involvement in the September 1993 blast outside the headquarters of the All India Youth Congress (AIYC) in New Delhi, resulting in death of eight persons. He was sentenced to death by a Delhi court in the case. His plea for parole will be considered after he moves an application seeking the same. Though the Supreme Court had upheld his death penalty but later it was commuted to life term on medical grounds. Bhullar is currently undergoing treatment at the Guru Nanak Dev Hospital here. He was not present in the TADA court that heard his bail application. He was admitted to the psychiatry ward of the hospital on June 12 last year after he was transferred on medical grounds from a hospital in New Delhi. He had complained of depression and other psychological problems.   2. Reported Missing 25 Years Ago, Prof. Bhullar’s Father is Finally Declared Dead by Bathinda Court By Sikh24 Editors - May 31, 2017 BATHINDA. Punjab—A Bathinda based Court of Civil Judge Parsmeet Rishi has declared S. Balwant Singh Bhullar (father of political Sikh prisoner Prof. Devenderpal Singh Bhullar) dead after 25 years of his abduction by the Punjab police cops. The Court has declared him dead on the ground that no one was able to make any contact with him in the past 7 years. The Court has pronounced its decision after taking affidavits from Prof. Devenderpal Singh Bhullar and his brother Tejinderpal Singh Bhullar that they had no objection in declaring S. Balwant Singh Bhullar dead by the Court. As per eyewitness reports, S. Balwant Singh Bhullar was kidnapped by tge Bathinda police from his home in Dyalpura Bhaika on December 12, 1991. Amongst several eyewitnesses, Mukhtiar Singh had confessed that the police had picked up Prof. Bhullar’s father and later declared him as missing. It is pertinent to note here that Bibi Upkar Kaur (mother of Prof. Devenderpal Singh Bhullar) had moved a petition in Bathinda Court on January 14, 2013 against police officers for abducting and killing her husband. Prof. Bhullar’s father, uncle and a friend were abducted and subjected to ‘enforced disappearance’ in December 1991 by Punjab police cops led by ex-DGP Sumedh Saini. Meanwhile along with extrajudicial murder of his father, Prof. Devender Pal Singh Bhullar was sentenced to death in a case pertaining to a deadly attack on the president of India’s ‘anti-terrorist’ unit, Maninderjit Bitta. Bitta was employed by the Indian state to employ ruthless force on Sikh youth in Punjab. He was then targeted for his brutality by Sikh freedom fighters during the post 1984 period. Professor Bhullar was then unjustly arrested as a suspect in the attack, despite simply being an outspoken lecturer in Ludhiana. Since his incarceration, he has been confirmed medically as having dipped into a severe state of mental instability due to his treatment in prison. In June 2015, Prof. Bhullar was transferred to the Central Jail of Amritsar in Punjab by the government, under pressure of the Bapu Surat Singh hunger strike campaign to free illegally held Sikh prisoners.   3. The Supreme Court bench heard today, that the Centre has "no problem" with the commutation of Professor Devinderpal Singh Bhullar's death sentence in to a life term. The petition filed by his wife Navneet Kaur, was on the grounds of relief due to a delay by the government in deciding his mercy plea which was filed in 2003. Attorney General Vahanvati told the bench headed by Chief Justice Sathasivam, "this is a case which has to be allowed because the mercy petition of the convict was decided after a delay of eight years". A short order will be pronounced by the Court on 31st March. This petition was filed after the landmark judgement made in January this year, when the court held that prolonging the execution of a death sentence has a "dehumanising effect" on condemned prisoners who have to face the agony of waiting for years under the shadow of death during the pendency of the mercy plea. While this has no doubt provided some relief in the 20+ years battle to clear Professor Bhullar's name, Sikh organisations and human rights activists have been calling for Professor Bhullar's immediate release, saying there can be 'no other outcome' to this grave injustice against an innocent man. Yesterday, SOPW had been informed by the family of Professor Bhullar, that the Supreme Court met to hear the petition filed by Navneet Kaur, on behalf of her husband Professor Devinderpal Singh Bhullar. She has appealed for his death sentence to be commuted to life imprisonment on the grounds of his mental health and because of the inordinate delay by the Government in deciding his mercy petition. In an earlier hearing, the Centre had been granted a further two weeks to decide upon the petition but today, the Court was told that it was "still under consideration". The bench, headed by Chief Justice Sathasivam, adjourned the case and told Attorney General Vahanvati, "if you inform us (about the decision taken) it is well and good or we will decide the case”. The Chief Justice also revealed that there have been recent cases where the Government has not taken the advice of its law officers seriously and the Centre has rejected their letters outright. Although, at last week’s Supreme Court hearing, Sikh groups welcomed the Union Governments decision that Professor Bhullar would not be executed, there is a strong demand that Devinderpal Singh Bhullar must now be set free. The real tragedy is that the pain of the past 19 years should never have been endured by Bhullar and his family. The disappearance and eventual killing by Punjab Police, of Professor Bhullar's father and uncle is believed to have been a turning point in his life. The two were picked up in December 1991 after Police could not find Bhullar, who they were trying to frame in a case for which he was later acquitted. The Professor, who at the time taught at Ludhiana Polytechnic, immediately went underground only three months after he had married Navneet Kaur, as he knew he was next on the list to be ‘disappeared’. He sought political asylum in Germany, from where he was deported – a decision which the German Government later admitted was a gross injustice as his life, truly was in danger if he was returned to India. In 1995 he was tried and convicted in the Delhi car bomb case. This turn of events shocked his colleagues and friends, who remember the mechanical engineering graduate from Ludhiana's Guru Nanak Engineering College as a studious man, who loved hockey. The Tamil community have also been showing their support for Professor Bhullar and the plight of the Sikhs, at a recent rally on 2nd March in Tamil Nadu and also at a protest that took place in New Delhi against the Tamil genocide. JALANDHAR: Devinder Pal Singh Bhullar, the death-row convict whose plea seeking commutation of his death sentence to life imprisonment was recently turned down by the Supreme Court, has received support from an unexpected quarter: former Punjab and Maharashtra DGP SS Virk. Virk told TOI on Friday that Bhullar was not guilty of what he was being accused of. Bhullar was convicted for the 1993 Delhi bomb blastthat killed nine people. "Bhullar not only should be given clemency for spending 18 years in jail, but he also deserves justice as he and his family have been wronged," said Virk. "I fought terrorism almost my entire professional life but I firmly believe that it is my duty to speak out if injustice is being done." Virk said he had studied Bhullar's case and it belonged to the rarest-of-the-rare category. "Bhullar was awarded death penalty despite a split judgment in this case," he said. "The presiding judge of the Supreme Court bench, Justice MB Shah, had acquitted Bhullar and there was no clinching evidence against him except his 'confession' in police custody." Virk said even former militants had vouched for Bhullar's innocence. "A number of ex-terrorists, who later joined the mainstream, had told me that Bhullar had refused to participate in any terror-related activity even when he was in hiding after his father and uncle were picked up by the police and eliminated," he said. "From these queries, a picture of a well-educated young engineering teacher emerged, not that of a dreaded militant he was made out to be." Virk, a Maharashtra-cadre IPS officer who retired in 2009, received the Padma Shri for fighting militancy in Punjab. A terrorist's bullet had hit him in the jaw at the Golden Temple in Amritsar in 1988 On April 12 the Supreme Court had dismissed Bhullar's petition seeking commutation of his death sentence. A Delhi court had convicted Bhullar for the 1993 bombing and sentenced him to death in 2001; in 2011 then President Partibha Patil had rejected his mercy plea. Sikhs in Uk have been protesting outside 10 Downing street since Friday non stop since Friday Potential death of an innocent man who has been in a hospital for 6 months or so because of mental health issue And yet no media outlets in Uk or the world are reporting this. Not even a signal mention. I cannot applaud and be proud of the Sangat who are there right now and overnight. It gets me so angry however, that our efforts are falling on deaf ears here. It goes to show that politicians and media don't care about protests or whatever it doesn't matter to them one bit if it don't interest them. The thing they are interested in is money and power. This is what we have to take away from them to get noticed. We can stop our voting or funding for these parties then that would be a start, its drastic but it would make them notice. It might just be a slight dent to these politicians but it will make them notice. Let them know that if they don't even at least acknowledge the fact that we have been protesting that we will take some sort of action against them. Stop funding these politicians if we even do now because this is all they care about. If we can all unite and this is the big thing but if we unite together we can make a bigger difference, if anyone got any ideas of how to tackle this add them on here.
