Senior lawyer Phoolka withdraws from anti-Sikh riot cases

Advocate H.S.Phoolka A senior advocate, appearing for the 1984 anti-Sikh riots victims in different courts, on Tuesday decided to withdraw from all the cases following allegations of "personal benefits" levelled against him.

"I'm constrained to take a hard decision to withdraw from all the cases of 1984 riots in view of a statement made by Delhi Sikh Gurudwara Management Committee.

"I have not charged a single penny for the (riot) cases but now even near clerical expenses incurred by the Gurudwara Committee are termed as wastage," senior counsel H.S. Phoolka said.

"I'm forced to take this drastic step because these allegations immensely disturbed me," he said.

He informed about his decision in an SMS sent to this journalist late tonight.

Mr. Phoolka has been on the forefront of raising a banner of support for the riot victims during judicial proceedings. He was appearing on behalf of the victims in riots cases filed against senior Congress leaders Jagdish Tytler and Sajjan Kumar.

NEW DELHI: Just when the conviction of a political leader for the 1984 massacre seems more realistic than ever before, the advocate who spearheaded the struggle all these years, H S Phoolka, has decided to withdraw from all the riot cases. This is in response to an allegation made by the president of DSGMC, Paramjit Singh Sarna, that Phoolka had "wasted" the community's money in the course of his campaign for justice.

Phoolka's withdrawal decision comes two days after former Congress MP Sajjan Kumar suffered a major setback as the Delhi high court upheld a murder charge framed against him in a case in which victim Jagdish Kaur has already identified him during the trial as the leader of the mob that had killed her husband.

Speaking to TOI, Phoolka said that he was forced to think of giving up the 1984 cause as he had been "abused and humiliated" by Sarna on July 17 at a meeting in which several prominent Sikhs, including senior advocate K T S Tulsi, were present. "I was hurt that when Sarna had attacked my integrity and record of service, not a single Sikh, not even my bar colleague Tulsi, came to my defence," Phoolka added.

The burden of Sarna's attack at the meeting was that when Phoolka appeared before the Justice G T Nanavati Commission on behalf of victims from 2000 to 2004, DSGMC had spent Rs 1.09 crore on the administrative expenses incurred by his team. This, he alleged, proved to be a waste as no benefit came out of it to the Sikh community.

Rubbishing this, Phoolka said much good had come out of the Nanvati probe: PM Manmohan Singh apologized for the carnage, the compensation for the families of dead victims was enhanced to Rs 10 lakh, Jagdish Tytler resigned from the Cabinet and the cases that Sajjan is currently facing were reopened on the basis of that report.

Phoolka also asserted that for all the legal work he did in connection with the carnage before various inquiry bodies and courts, "I never charged a penny as my fee. Whatever was spent by DSGMC was on unavoidable..." Sarna said that he had fallen out with Phoolka over a proposal to file a complaint against minister Kamal Nath as he had been found by the Nanavati Commission to have been present when a mob attacked Rakabganj Gurdwara and killed two Sikhs. Since Nath was given the benefit of the doubt by the commission, Sarna was unconvinced about Phoolka's suggestion to file the complaint.

Phoolka said he had now decided to write to Akal Takht, to make alternative arrangements for representing victims before courts. Tulsi, on his part, said the dispute raised by Sarna could not be taken as a reflection on Phoolka's immense contribution to the cause.

ਭਾਰਤ ਦੀ ਆਮ ਚੋਣਾਂ ਦੇ ਸਮੇਂ ਜਦੋਂ ਸਜਣ ਕੁਮਾਰ ਅਤੇ ਜਗਦੀਸ਼ ਟਾਇਟਲਰ ਨੂੰ ਟਿਕਟ ਦੇ ਦਿਤੀ ਗਈ ਅਤੇ ਉਸ ਦੇ ਵਿਰੋਧ ਕਰਦਿਆਂ ਜਰਨੈਲ ਸਿੰਘ ਪਤਰਕਾਰ ਨੇ ਜੂਤਾ ਮਾਰਿਆ, ਜਿਦ ਦੀ ਬਦੋਲਤ ਸਜਣ ਕੁਮਾਰ ਅਤੇ ਟਾਇਟਲਰ ਦੀ ਟਿਕਟ ਪਾਰਟੀ ਵਲੋਂ ਕਟ ਕੇ ਉਸੀ ਸਜਣ ਕੁਮਾਰ ਦੇ ਸਗੇ ਭਰਾ ਨੂੰ ਦੇ ਦਿਤੀ ਗਈ ਉਸ ਸਮੇ ਵੀ ਸ. ਪਰਮਜੀਤ ਸਿੰਘ ਸਰਨਾ ਨੇ ਭਾਈ ਜਰਨੈਲ ਸਿੰਘ ਦੀ ਨਖੇਧੀ ਕੀਤੀ ਅਤੇ ਸਜਣ ਕੁਮਾਰ ਦੇ ਭਰਾ ਦੀ ਚੋਣਾਂ ਵਿਚ ਹਿਮਾਇਤ ਕੀਤੀ , ਸਜਣ ਕੁਮਾਰ ਨਾਲ ਸਰਨਾ ਦਲ ਦੇ ਸੰਬਧ ਨਵੇ ਨਹੀ ਸਗੋਂ ਕਾਫੀ ਪੁਰਾਣੇ ਹਨ , ਸੰਨ 2005 ਵਿਚ ਸਮੇ ਦੇ ਮੋਜੂਦਾ ਮੀਤ ਪ੍ਰਧਾਨ ਬਲਦੇਵ ਸਿੰਘ ਰਾਣੀ ਬਾਗ ਜੋ ਅਜ ਕਲ ਵੀ ਸਰਨਾ ਦਲ ਦਾ ਖਾਸ ਮੈਂਬਰ ਹੈ , ਉਹਨਾਂ ਨੇ ਇਕ ਸਮਾਗਮ ਦੋਰਾਨ ਸਜਣ ਕੁਮਾਰ ਨੂੰ ਕਿਰਪਾਨ ਭੇਟ ਕਰ ਸਨਮਾਨਤ ਕਿਤਾ । ਸਿੱਖ ਜਗਤ ਅਜ ਤਕ 1984 ਦੇ ਸਾਕਾ ਨਿਲਾ ਤਾਰਾ ਦਾ ਅਤੇ ਸਿੱਖ ਕਤਲੇਆਮ ਦਾ ਦਰਦ ਹੰਡਾ ਰਿਹਾ ਹੈ , ਅਜ ਵੀ ਦਿੱਲੀ ਦੀਆਂ ਕਈ ਗਲੀਆਂ ਉਸ ਕਤਲੇਆਮ ਦੇ ਜ਼ਖਮ ਅਪਣੀ ਬੁਕਲ ਵਿਚ ਲਈ ਬੈਠੀ ਹੈ ਜਿਸ ਦਾ ਮੁਖ ਦੋਸ਼ੀ ਸਜਣ ਕੁਮਾਰ ਅਤੇ ਜਗਦੀਸ਼ ਟਾਇਟਲਰ ਹਨ । ਕਈ ਬਜੂਰਗ ਅੱਖਾਂ ਕਈ ਵਿਧਵਾ ਔਰਤਾਂ ਅਜ ਵੀ ਭਾਰਤ ਦੀ ਅਦਾਲਤਾਂ ਵਲ ਇਨਸਾਫ ਦੀ ਆਸ ਲ਼ਾਈ ਬੈਠੀਆਂ ਹਨ ਕਿ ਕਦੋਂ ਸਜਣ ਕੁਮਾਰ ਜੈਸੇ ਕਾਤਲਾਂ ਨੂੰ ਸੁਜ਼ਾ ਮਿਲੇ, ਪਰ ਉਹਨਾਂ ਨੂੰ ਸਜ਼ਾ ਦਿਵਾਉਣੀ ਤਾਂ ਦੁਰ ਇਹ ਉਹਨਾਂ ਕਾਤਲਾਂ ਨੂੰ ਸ਼੍ਰੀ ਸਾਹਿਬ ਭੇਟ ਕਰ ਸਨਾਮਾਤ ਕਰਦੇ ਹਨ ।

ਸ਼ਾਇਦ ਸਿੱਖ ਪੰਥ ਦੇ ਦੋਖੀਆਂ ਨਾਲ ਸੰਬਧ ਬਨਾਉਣਾ ਸ. ਪਰਮਜੀਤ ਸਿੰਘ ਸਰਨਾ ਨੇ ਰੀਤ ਹੀ ਬਣਾ ਲਈ ਹੈ , ਜਦੋਂ ਸੰਸਾਰ ਭਰ ਦੇ ਸਿੱਖ ਅੱਖਾ ਨਮ ਕਰਕਿ 1984 ਦੇ ਸਾਕਾ ਨਿਲਾ ਤਾਰਾ ਅਤੇ ਸਿੱਖ ਕਤਲੇਆਮ ਦੇ ਸ਼ਹੀਦਾ ਦੀ 25 ਸਾਲਾ ਬਰਸੀ ਮਨਾ ਰਹੇ ਸਨ ਉਸ ਸਮੇਂ ਪੰਥ ਦੇ ਸ਼ਹੀਦਾਂ ਦਾ ਅਪਮਾਨ ਕਰਦੇ ਹੋਏ ਸ. ਪਰਮਜੀਤ ਸਿੰਘ ਸਰਨਾ ਨੇ ਖਾਲਸਾ ਪੰਥ ਦੇ ਦੋਖੀ ਲਾਲਾ ਜਗਤ ਨਾਰਾਇਣ ਦੇ ਪੁਤਰ ਰਮੇਸ਼ ਚੰਦਰ ਦੀ ਬਰਸੀ ਗੁ. ਰਕਾਬ ਗੰਜ ਸਾਹਿਬ ਦੇ ਭਾਈ ਲੱਖੀ ਸ਼ਾਹ ਵਣਜਾਰਾ ਹਾਲ ਵਿਚ ਮਨਾਈ । ਇਹ ਉਹੀ ਰਮੇਸ਼ ਚੰਦਰ ਹੈ ਜਿਸ ਨੇ ਅਪਣੇ ਅਖਬਾਰ ਪੰਜਾਬ ਕੇਸਰੀ ਵਿਚ ਸਿੱਖ ਪੰਥ ਦੀਆਂ ਭਾਵਨਾਵਾਂ ਦਾ ਮਜ਼ਾਕ ਬਣਾਇਆ , ਸਮੇਂ ਸਮੇਂ ਸਿਰ ਰਮੇਸ਼ ਚੰਦਰ ਨੇ ਅਪਣੇ ਅਖਬਾਰ ਦੇ ਸਹਾਰੇ ਸਿੱਖ ਪੰਥ ਬਾਰੇ ਅਪਮਾਨਜਨਕ ਲੇਖ ਲਿਖੇ । ਉਸ ਦੇ ਪਿਤਾ ਲਾਲਾ ਜਗਤ ਨਾਰਾਇਣ ਦੀ ਹਰਕਤਾਂ ਤੋਂ ਵੀ ਸੱਭ ਜਾਣੂ ਹਨ ਕਿ ਕਿਵੇਂ ਉਸ ਨੇ ਸਿੱਖ ਵਿਰੋਧੀ ਕਾਰਵਾਈ ਕਿਤੀਆਂ ਅਤੇ ਅਮ੍ਰੀਤਸਰ ਦੇ ਸਟੇਸ਼ਨ ਤੇ ਪਈ ਦਰਬਾਰ ਸਾਹਿਬ ਦੇ ਮੌਡਲ ਨੂੰ ਤੋੜ ਸਿੱਖ ਪੰਥ ਦੇ ਖਿਲਾਫ ਨਾਅਰੇ ਲਗਾਏ ਗਏ । ਇਹ ਸੱਭ ਜਾਣਦੇ ਹੋਏ ਵੀ ਪਰਮਜੀਤ ਸਿਘ ਸਰਨਾ ਨੇ ਗੁ. ਰਕਾਬ ਗੰਜ ਸਾਹਿਬ ਵਿੱਖੇ ਰਮੇਸ਼ ਚੰਦਰ ਦੀ ਬਰਸੀ ਮਨਾਈ

ਆਖਰ ਕਿਉਂ ਪਰਮਜੀਤ ਸਿੰਘ ਸਰਨਾ ਦੇ ਰਿਸ਼ਤੇ ਪੰਥ ਦੇ ਦੋਖਿਆਂ ਨਾਲ ਸਮੇ ਸਮੇ ਸਿਰ ਉਜਾਗਰ ਹੂੰਦੇ ਆ ਰਹੇ ਹਨ , ਬਾਰ ਬਾਰ ਅਕਾਲ ਤਖਤ ਸਾਹਿਬ ਦੇ ਹੁਕਮਾਂ ਦੀ ਨਫੁਰਮਾਨੀ ਕਰ ਐਸੇ ਦੋਖਿਆਂ ਨਾਲ ਸੰਬਧ ਰੱਖ ਕੇ ਸ. ਸਰਨਾ ਕੀ ਸਾਬਤ ਕਰਨਾ ਚਾਹੰਦੇ ਹਨ ।ਜਦੋ ਵੀ ਕੋਈ ਅਵਾਜ ਪਰਮਜੀਤ ਸਿੰਘ ਸਰਨਾ ਦੇ ਗਲਤ ਕਾਰਵਾਈ ਖਿਲਾਫ ਚੂਕੀ ਜਾਂਦੀ ਹੇ ਤਾਂ ਕਿੰਉ ਉਸ ਨੂੰ ਦਬਾਉਣ ਦੀ ਕੋਸ਼ੀਸ਼ ਕੀਤੀ ਜਾਦੀ ਹੈ । ਅਪਣੀ ਗਲਤੀਆਂ ਉਤੇ ਪਰਦੇ ਪਾਉਣ ਲਈ ਪਰਮਜੀਤ ਸਰਨਾ ਹਮੇਸ਼ਾ ਤੋਂ ਹੀ ਦੁਜਿਆਂ ਨੂੰ ਬਦਨਾਮ ਕਰਦੇ ਰਹੇ ਹਨ । ਇਹਨਾਂ ਦੇ ਇਕ ਹੋਰ ਝੂਠ ਦੀ ਪੋਲ ਗੁਰੂ ਸਾਹਿਬ ਦੀ ਅਸੀਸਾਂ ਸਦਕਾ ਸੰਗਤਾਂ ਸਨਮੂਖ ਹਾਜਰ ਹੈ ।

Sarna did it as per order of Congress, H.S. Phoolka is very nice person, he helped the victims , he even got threats and offers too but he was a real sikh fighting for his own sikh brothers , Even some time sardar phoolka financially helped the victims and singh accused in fake cases and obviously congress dont want that , so congress agent Sarna played his trick . Delhi Sangat Wake up . kick him out of DSGMC .. If u really want justice support Sardar Phoolka ..

I find it hard to believe a man of HS Phoolka's conviction would pull out at this stage regardless of the dirty Sarna/Congress conspiracy against him.

To Delhi Sangat....Can the global sangat provide the funds to Bhai HS Phoolka, if that's the issue? What quick actions can we get our Gurdwara leaders to do over in the UK to support at this stage?

Sardar Phoolka ji has been literally waging a battle to get justice for the victims.

Khalsa ji, Last night Senior Lawyer H S Phoolka called me on phone to tell his decision to quit from all 1984 cases. He said he is forced to take this decision as DSGMC president Paramjit Singh Sarna levelled an allegation of wasting money on these cases and said it's a futile excercise. Sarna said there is even no need for wasting money on Nanavati Commission. It is shameful to say that it was waste of money.

Sarna and his anti Dasam Granth brigade are crossing their limits. Their anti-Panthic activities were already unbearable. There is a video on Panthic.org where you can see small cigarettes and pieces of chicken lying around a marriage hall which is inside the premises of one of the historic Gurdwaras in Delhi (I am guessing it was Rakab Ganj Gurdwara Sahib...please correct me if I am wrong). The place where Maharaj's saroop was prakash, they put some other stuff over there. That video was immensely disturbing and disgusting to watch.

Speaking to TOI, Phoolka said that he was forced to think of giving up the 1984 cause as he had been "abused and humiliated" by Sarna on July 17 at a meeting in which several prominent Sikhs, including senior advocate K T S Tulsi, were present. "I was hurt that when Sarna had attacked my integrity and record of service, not a single Sikh, not even my bar colleague Tulsi, came to my defence," Phoolka added.
