Ludhiana/Punjab (September 20, 2012): According to recent reports available with Sikh Siyasat SGPC member and Akali Dal Panch Pardhani (ADPP) President Bhai Kulbir Singh Barapind and ADPP supreme council member Bhai Daljeet Singh who were arrested by Punjab Police, have been remanded to judicial custody and are sent to Ludhiana Jail.

Bhai Kulbir Singh Barapind was arrested from his house around midnight on the intervening night of 19 and 20 September by Nawanshehr police, while Bhai Daljeet Singh was arrested by Ludhiana police by from his residence on 20 September at around 9 am. Both of them were lodged in Ludhian jail.

According to Times of India (TOI) news report “[E]ven as till Thursday morning Jalndhar Rural Police, under which village Barpind is located, claimed that it was not aware of the arrest. Nawanshahr SSP Dhanpreet Kaur said that it was a preventive detention in the wake of Bharat Bandh call. A team of police officials led by Nawanshahr SP (HQ) Dharam singh Uppal picked Barapind from his house and did not give any reason to him or his family to round him up”.

“He was sent to judicial custody in Ludhiana jail till September 25 after he was produced by police before a magistrate after arresting him under sections 107/151 CrPC at around 9.30”, TOI report adds.

It further adds that the explanation by police officials to link the detentions with Bharat Bandh call sounded bizarre as Akali Dal Panch Pardhani had neither given a call for and bandh nor had articulated its views in support of FDI in retail.

Dal Khalsa has strongly criticized the arrests of Sikh leaders.

“Both the leaders and their party have remained neutral to the current political controversy and to term their arrest preventive in view of the bandh call is ridiculous and reflects that in Punjab police could put anybody behind bars anytime without any solid reason,” said Dal Khalsa spokesperson Kanwarpal singh while criticizing the arrests.

Kanwarpal Singh argued that “If state government and police apprehended any disturbance to peace then SAD-BJP workers should have been arrested as they were participating in the bandh”.

According to TOI report Jalndhar (Rural) SSP Yurinder Singh Hayer said that they had not arrested anybody else in the district as a preventive measure.

As the two arrests stood isolated with no preventive arrests of other political activists the police officials were feeling short of words to explain the actual reason.

TOI has quoted sources as saying that there were some other reasons to pick them up from their houses and orders had come from ‘above’.

“The reason later given by the local police officials was after thought, said a police source” says TOI news report.

It is notable that Bhai Kulbir Singh Barapind was extradited from United States of America. He was tried in three cases and was acquitted in all the cases. He happens to be the only SGPC member of anti SAD (Badal) factions from entire Doaba region. He had won the election from Phillaur constituency.

Phillaur/Punjab (September 20, 2012): According to information extended by Akali Dal Panch Pardhani, Bhai Kulbir Singh President of ADPP was arrested by Nawanshehr Police last night. According to information the police conducted a raid at midnight at Bhai Kulbir Singh’s house and he was taken into custody. Bhai Kulbir Singh was recently selected as President of Akali Dal Panch Pardhani, a Sikh Political party. He is also member of Shiromani Gurudwara Prabhandak Committee (SGPC) from Phillaur constituency.

Police is also reported to have arrested Bhai Daljit Singh, former President of Akali Dal Panch Pardhani early morning by Ludhiana Division Number 5 Police. According to information the police has claimed to have been arrested as “preventive measures”.

Panch Pardhani sources told Sikh Siyasat that no reason has been tendered for arrest of Bhai Kulbir Singh so far. Bhai Mandhir Singh, Secretary General of Panch Pardhani told Sikh Siyasat that theywould be meeting Nawanshehr SSP regarding this matter.

Bhai Daljit Singh charged under UA(P)A – sent on 5 days police remand; Panch Pardhani Office sealed

Ludhiana/Punjab (September 21, 2012): According to latest information Ludhiana Police produced Bhai Daljit Singh Bittu former President of Akali Dal Panch Pardhani in Chief Judicial Magistrate (CJM) Mr. Asis Thathai’s court levelling allegations of serious offences against him and demanded police remand for ten days. CJM has sent Bhai Daljit Singh on five days police remand.

Police has registered F.I.R. No. 183 dated September 21, 2012 against Bhai Kulbir Singh under Indian Penal Code Sections 120-B (Criminal Conspiracy), 121 (Waging War against the State), 121A (Conspiracy to Wage War against the State; Sections 25, 54, 59 and 25A of Arms Act; Sections 3, 4, and 5 of Explosive Act and Sections 17, 18, 18A, 19, 20, 38, 39, 40 of Unlawful Activities (Prevention) Act.

It is notable that in a separate FIR no. 137/12 registered at Goraya Police has registered a case Bhai Kulbir Singh Barapind President of Akali Dal Panch Pardhani under same sections.

It is notable that a police party today raided the Gurdev Nagar Ludhiana based resident of Bhai Daljit Singh this morning and searched the house for more than six hours. Police has seized two personal computers, books and other documents. Police informed that court that it has seized papers/documents in five bags.

Similer raid was conducted by police in Maharaj Nagar, Ludhiana based office of Akali Dal Panch Pardhani and according to information police has sealed the entire building of ADPP office.

Bhai Daljit Singh Bittu’s councils Advocate Harpal Singh Cheema, Advocate Jaspal Singh Manjhpur and Advocate Gurmeet Singh Rattu appeared in the court and opposed the remand demanded by the police. Advocate Jaspal Singh Manjhpur argued that in the FIR the police has accused Bhai Daljit Singh for offences under Arms Act and Explosives Acts without any recovery, and at the same time police has already sealed the ADPP office. So in this situation police could easily plant any recovery against Bhai Daljit Singh. He requested the court to take the note of these facts. Upon court query the police admitted that it has sealed the ADPP office and it’s keys are with the police and CJM took a noting of this fact on court records.

Police demanded ten days police remand which was strongly opposed by Bhai Daljit Singh’s councils but CJM sent Bhai Daljit Singh on five days police remand.

It is notable that Police has levelled similar allegations against Bhai Daljit Singh that, earlier today, were levelled by Goraya Police against Bhai Bhai Kulbir Singh Barapind including allegations of links with Babbar Khalsa International (BKI) and Pakistan, allegations regarding funds etc.

It is notable that Unlawful Activities (Prevention) Act, 1967 was amended on December 31, 2008 by the Indian Parliament, soon after the 26/11 Mumbai Attacks. According to Human Rights organizations and legal experts these amendments were aimed at making UA(P)A – a replacement of notorious TADA and POTA laws, that were repealed thorough abuse.

Many Human Rights Organizations have alleged from time to time, since the amendments that UA(P)A is being abused to crush the political dissent.

5 days police remand of Bhai Kulbir Singh; Police charging him for Waging War against the State & holding links with BKI

Goraya/Phillaur/Ludhiana, Punjab (September 21, 2012): According to latest information Goraya Police produced Bhai Kulbir Singh Barapind in Chief Judicial Magistrate (CJM) Mr. Jatinder Pal Singh’s court levelling allegations of serious offences against him and demanded police remand for ten days. CJM has sent Bhai Kulbir Singh on five days police remand.

Police has registered F.I.R. According to sources a police party in around 40 vehicles raided the house of Bhai Kulbir Singh Barapind this morning and searched the house and surroundings at village Barapind near Phillaur for more than two hours while Bhai Barapind was lodged in Ludhiana Jail.

It is notable that police conducted the search without any search warrant and when this point was raised by Bhai Kulbir Singh’s council Advocate Kashmir Singh Mallhi in the court of the CJM, the police claimed that it had received urgent and instant information therefore it had no time to secure search warrant. However Advocate Mallhi challenged the police claim and informed that court that Bhai Kulbir Singh was already arrested by Nawanshehr Police on the intervening night of 19 and 20 September, 2012 and he was sent to Ludhiana Jail therefore it was not possible for Goraya Police to obtain alleged urgent information from him.

DSP Phillaur demanded ten days police remand which was strongly opposed by Bhai Kulbir Singh’s council but CJM sent Bhai Kulbir Singh on five days police remand.

Police has alleged that Bhai Kulbir Singh was a Babbar Khalsa International (BKI) activist and had links with Ranjeet Singh Neeta and Jagtar Singh Tara.

Police has alleged that Bhai Kulbir Singh has received 1 crore and 75 lakh rupees from foreign sources to carry on Babbar Khalsa activities.

Police has also referred to a case registered at Delhi under various sections of Unlawful Activities (Prevention) Act by National Investigative Agency (NIA) of India. According to news-reports of past few weeks the Delhi case by NIA is supposed to have been registered against UK based NGO, Sikh Prisoner Welfare Organization (SPOW) (http://prisonerwelfare.com/) and a website named NeverForget84.Com (http://neverforget84.com) for allegedly funding BKI activities.

Akali Dal Panch Pardhani leadership has strongly condemned the police claims as baseless arguments. Bhai Kulbir Singh is President of Akali Dal Panch Pardhani, a Sikh political party and he is democratically elected member of Shiromani Gurudwara Prabhandak Committee (SGPC) from Phillaur Constituency, in-fact he is the only member of SGPC from entire Doaba region who won the election against ruling SAD (Badal)’s candidate in SGPC election. SGPC is a statutory body and SGPC elections are conducted by Gurudwara Election Commissioner under the notification of Ministry of Home Affairs, India.

There is information that Ludhiana police has obtained production warrants of Bhai Daljit Singh Bittu, former President of Akali Dal Panch Pardhani (ADPP) and now the police will be producing him in Ludhiana court. It is suspected that he could be charged under Unlawful Activities (P) Act and other laws.

It is notable that Unlawful Activities (Prevention) Act, 1967 was amended on December 31, 2008 by the Indian Parliament, soon after the 26/11 Mumbai Attacks. Unlawful Activities (P) Act lashed against Bhai Kulbir Singh Barapind; Police raids continue ADPP leaders’ house & office

Goraya/Ludhiana, Punjab (September 21, 2012): According to recent reports the Goraya Police has registered a case under Unlawful Activities (Prevention) Act, 1967 against Akali Dal Panch Pardhani (ADPP) president Bhai Kulbir Singh. As per reliable sources the Police has showed the recovery of 1 Pistol, 1 Air Gun and two bullet-proof jackets and has obtained the production warrant of Bhai Kulbir Singh Barapind.

On the other hand Ludhiana police is reported to have conducted a thorough search operation at the house of ADPP former president Bhai Daljit Singh Bittu this morning that lasted for more than five hours. Police is reported to have seized books and computers from Bhai Daljit Singh’s house.

It is notable that Nawanshehr Police had arrested Bhai Kulbir Singh from his Barapind Village, near Phillaur, based residence on the intervening night of 19 and 20 September, 2012; while Bhai Daljit Singh Bittu was arrested by Ludhiana police from his Gurdev Nagar Ludhiana based residence on September 20, 2012 at around 9 am. Both Sikh leaders were charged under 107/151 of Criminal Procedure Code, 1973 and were sent to Ludhiana Jail.

Various news reports revealed that the police had claimed to have carried these arrests as a preventive measure in wake of Bharat Bandh Call but even independent news sources/reports had ridiculed the police claim as ADPP was neutral on the FDI issue and Bharat bandh call.

As per reports the Ludhiana police is conducting a thorough search operation at Maharaj Nagar, Ludhiana based office of Akali Dal Panch Pardhani.

Now, Goraya Police has obtained production warrants of Bhai Kulbir Singh and it is expected that police shall demand his police remand.

It is notable that ADPP had faced police lash out in August-September, 2009 when Bhai Daljit Singh Bittu, the then President of ADPP was charged with UA(P)A. Bhai Daljit Singh was released on bail from Amritsar Jail on February 28, 2012.

Akali Dal Panch Pardhani leaders said that they are being repeatedly targeted by the Indian state just because their dissenting political ideology and false cases are being registered against top leadership of ADPP. It is notable that Bhai Daljit Singh is regularly being charged with UA(P)A and Sedition but most of the times state prosecution failed to prove the charges in the courts. He was charged with dozens of cases but not convicted even in a single case till date. Similarly, Bhai Kulbir Singh was charged in three cases and was acquitted by the courts in all cases.

Many Panthic Singhs(Bhai Ajnala, Mann, Daduwal, Bittu etc) from all over Punjab were also arrested during the strike relating to Bhai Rajoana a few months ago in Punjab. At the time, even Wassan Singh Zafferwal was arrested even though he is no longer active in Sikh affairs. These men were picked up by the police for no reason. The excuse the police gave was that it is a preventive measure. Many of us may not know this, the Punjab government is very active in keeping intelligence in Punjab. I have a relative who is a sarpanch in a village near Amritsar, he tells me that every now and then, he will receive phone calls from the CID asking him info about certain people in the village who are potentially Panthic minded.

Surprisingly when Panthic Singhs from all over Punjab were picked up during the Rajoana strike a few months ago, it is worth noting that Baba Harnam Singh Dhuma and some other prominent Sants(Baba Hari Singh Randhawa) who have links with the Akalis were not arrested, while Panthic Sants like Daduwal were arrested and let go only after Singhs cooled down.

This is a VERY, VERY important point. Also, Sikhs should be aware that they might mix a few non-Panthic Singhs to get arrested to show them off as being panthic.

While most of the people being arrested are panthic, just to attack Sikhs in a psychological method, they probably add a few non-Panthic sold out Sikhs that they tip off before hand.

Ultimately, blames lies with all the janta of punjab for picking up incompetent/corrupt leaders time after time, power has been under same old congress and akaalis since India constitution. The way things are going in punjab, one cannot help but think if punjab was better with british raj than our own scum bag leecher leaders...its quite a paradox.

The change in punjab has to come with self awareness within each punjabi living in punjab demanding for change. Lot of our sikhs abroad are focusing on change in panthic leadership at sri akaal takth sahib but such change will not effective until we address issues with punjab gov't as ultimately punjab gov't calls it shots.

What we need here is an highly educated un partial and secular leader in punjab standing up for next election in punjab which can address issues like accountability, corruption, broken punjab police structure, economy, jobs, environment, water. If we read anandpur sahib resolution which every sikh should read and memorize after all our shaheeds of 1984 died fighting for...most of issues listed applies to normal joe blow life in punjab life/fairness and prosperity in punjab. I believe if key issues of corruption, accountablity, punjab police structure reform, human rights issues are addressed all our panthic issues which are inter-connected will automatically be addressed.

I was born in Kolkata so i can see punjab situation from eagle eye and provide recommendations based on things which have worked greatly in Kolkatta. I am not saying punjab should adapt communist/marxist..that would be suicidal but adapt good things from it..its worth noting during 1984 riots in kolkata not even one single sikh out of thousands were killed by mobs, due to heavy police protection for sikhs under power of joti basu. Sikhs in Kolkata are highly in debt to joti basu for protecting miniorites in Kolkata.

We need to get new leader which can adapt policies from other states which have worked instead of same old old power struggle between congress and akaalis.

True, about Sikhs not being killed in Bangal during 84. I have heard that the congress in Bangal wanted to cause bloodshed, but Jyoti Basu the communist leader had given them a strict warning that if they try to do anything, they will be severely dealt with. Jyoti Basu was a great leader indeed.

That being said, I don't think Punjab should adopt the Bangal model of governance. Before 1947, Bangal was the most industrialized state and it's infrastructure was the most advanced in India. But because of the communist economic policies, it's industry suffered greatly. Because of it's inaction against foreign intruders, Bangal will be a Muslim majority state in the future thanks to the millions of Bangladeshis migrating to Indian Bangal. Even though Bangal is a Hindu majority state, but the communist government had made cow slaughter legal in the state.

Lets just say, Punjab is better off under the Akalis and Congress rather than living under the communists.
