Article 25 in The Constitution Of India 1949
25. Freedom of conscience and free profession, practice and propagation of religion
(1) Subject to public order, morality and health and to the other provisions of this Part, all persons are equally entitled to freedom of conscience and the right freely to profess, practise and propagate religion.
(2) Nothing in this article shall affect the operation of any existing law or prevent the State from making any law -
(a) regulating or restricting any economic, financial, political or other secular activity which may be associated with religious practice;
(b) providing for social welfare and reform or the throwing open of Hindu religious institutions of a public character to all classes and sections of Hindus.
Explanation I - The wearing and carrying of kirpans shall be deemed to be included in the profession of the Sikh religion
Explanation II - In sub clause (b) of clause reference to Hindus shall be construed as including a reference to persons professing the Sikh, Jaina or Buddhist religion, and the reference to Hindu religious institutions shall be construed accordingly.
The Constitution of India is federal in nature. Each state and each Union territory of India has its own government. However, Punjab has been denied its own capital as others States of India have. Instead, draconian laws allowing the central government to take control are in place. Chandigarh is a city and a union territory in the northern part of India that serves as the capital of the states of Haryana and Punjab. As a union territory, the city is ruled directly by the Union Government of India and is not part of either state.
Sikhs did not sign the constitution.

Indian Constitution is NOT federal but unitary in nature. State autonomy is suppressed using many articles and clauses in the Constitution. Even basic fundamental rights are subject to "national security, peace" etc. which are vague and deliberately written to allow the Center to trample over human rights. Emergency via presidential rule, suspension of state government etc. Are clear examples of this. This is why Sikhs foresaw the danger of such a document and refused to sign it as it was against the promises made by Congress. Article 25 is not the only reason but one of many reasons.

AMRITSAR: Akal Takht, the top temporal seat of the Sikhs, on Monday asked the members of the community to continue signing a petition "Sikhs are not Hindus" till December 31.

All India Sikh Students Federation (AISSF) and the US-based Sikhs For Justice (SFJ) have initiated the process to file the online petition, and the Sikh organizations wish that US President Barack Obama would raise the issue of separate status of Sikhism with Prime Minister Narendra Modi during his visit to India next year.

Akal Takht's head Gurbachan Singh directed the Shiromani Gurudwara Parbhandhak Committee (SGPC) to support the signature campaigns for the purpose to be held at Fatehgarh Sahib on December 26, 27 and 28.

Obama is likely to attend the Republic Day function as a chief guest on January 26.

Emphasizing that an "amendment" in Article 25 (b) is "must as it clubs Sikhs with Hindus", Singh said the petition mentioning "Sikhs are not Hindus", and more than 100,000 signatures will be presented to Obama by AISSF and SFJ.

The petition is the 16th most popular at the moment with 105,185 signatures. The other petitions have closed so the ranking could rise further.
