When does stating an opinion, or even cold facts, cross over into the territory of nindya? Does intention and the manner in which those thoughts are expressed have a bearing on how this issue is viewed?

In answer to the first question as that's all I can lol...Stating the truth cannot be deemed as Nindya as one is not concocting false stories to make oneself look superior. There is a BUT. Sometimes it's better to refrain from telling the truth if we think it can cause heartache.

This is why, I'm unable to answer the second part, where DO WE draw the line, are we in a position to decide if someone should be warned about another persons shortfalls? Someone like @N30S1NGH I feel may have a suitable javaab!

We see it all the time on this site. A person is "exposed" by presenting undeniable facts about their conduct, but his or her supporters adamantly present the nindya argument as a defence to shut down discussion.
