Don't think prison would have been beneficial in this case, but wonder if sentence would have been different if the guilty was a  Singh of the same age.

A law graduate ran over and killed a pedestrian after she lost control of her BMW and pressed the accelerator instead of the brake, a court has heard.

Raveena Raizada, 23, had a passenger in the front seat when she careered over a mini roundabout and ploughed into Manjit Singh Khaira, 59, in west London on March 27 last year. 

The student initially told police she had to swerve Mr Khaira, who she claimed 'was literally in the middle of the road'.

 

However, CCTV evidence revealed the pedestrian was walking along the pavement when she lost control of the car.

Raizadam who obtained a first-class degree in business and law at university, appeared at the Old Bailey on Tuesday to be sentenced having earlier pleaded guilty to causing death by careless driving.

The court heard that Mr Khaira was walking along a pavement in Hayes Road, Southall, in the same direction as the 3 series BMW when he was struck.

Accident investigators found that Raizada had lost control of the car and pressed the wrong pedal, causing the BMW to accelerate towards Mr Khaira rather than braking.

There was no traffic other than the defendant’s vehicle and no pedestrians in the area, the court heard. 

Edward Franklin, prosecuting, told the court: 'Our case is that this is a brief lapse of driving judgment comprising two if not three elements.

‘First of which is the initial loss of control, failure to apply the brakes and pedal confusion if that is what has occurred.

‘There was no reason at all that contributed to that loss of control other than driver error.'

Mr Franklin added that the defence was 'aggravated by attempt to shift blame onto the deceased'.

Despite Raizada's claim that she had to swerve to avoid the pedestrian, CCTV showed that 'at no point does the deceased move into the road'.

She was said to be 'in a complete state of shock' following the collision and her passenger had to relay what had happened.

Marianna Pasteris, defending Raizada, said in mitigation that she 'is of a very positive good character' and has 'great remorse' about the incident.

She added that the fatal collision has also had a 'very significant impact' on Raizada, who is on anti-depressants and was unable to continue studying a Master's degree.

Passing sentence, Judge Mark Dennis said: 'This has plainly had a dramatic effect on the defendant mental health.

Raizada, of Brookwood Road, Hounslow, was sentenced to a two-year community order and 150 hours of unpaid work.

She was also handed a 12-month driving disqualification and, following its expiration, she must take re-test before she can drive again.

What in the world? Only two years of community order? This is INSANE. You can get 20+ years of prison in the US for the same crime! The UK and Europe in general is pathetic when it comes to dealing with criminals.

Compared to the UK, American legal system is much better especially because any Jihadis they have jailed tend to never see the light of day, while the ones here just get out after 5-10 years even after they planned mass terror attacks. That's why all those Jihadi brides and terrorists want to come back from Syria now that the Islamic State has been defeated.

Ehh grass is always greener. We also over incarcerate, and have people doing life sentences for basically nothing. 

We violated international law and our own laws with what was done at Guantanamo. We received no actionable intel through torture and humiliated ourselves globally. Yes some of those guys are never getting out. Some of them are innocent though and that's messed up. But because of how bad we treated them we consider the innocent to be enemies for life because of what we've done and they're staying holed up. 

For verifiable isis recruits though, yeah a little five year welcome home stint isn't cutting it. Go back to isis. They're your fam now.

Whenever I see a case like this, my first suspicion is that the person driving was distracted by their phone. For the past 10 years every single time I see a young Asian girl driving a car, she's guaranteed to be stealing glances at her smartphone that she's either shamelessly holding in her hand, or she's propped it up somewhere where she can continue using it while driving. They are absolutely addicted to this technology. It's f****g terrifying how easy it is to end someone's life because someone lacks the self-control not to indulge themselves in their crappy social life for a few minutes during a car journey.

She had a BMW, why couldn't she have just used hands-free ?!

I've been doubly careful since reading this news when walking on footpaths/sidewalks, never know what could happen and never trust other motorists

My driving instructor gave me the best driving advice I've heard at the start of my first ever lesson. "Assume everyone driving on the road is an 1d1ot. Don't rely on them to ensure nothing bad happens to you." It really has focused my mind ever since I started driving, lol. I've saved myself from getting involved in countless accidents by anticipating the carlessness of other people.
