    As many as 24 police personnel, who were allegedly involved in a fake encounter, surrendered in a special CBI court here today.

    Earlier, all of them were declared proclaimed offenders by the court.

    On December 8, DSP Ram Singh, posted at PAP, Jalandhar, had already surrendered in the court of additional session judge Sukhwinder Kaur. He was accompanied by doctors when he had surrendered as he was suffering from heart ailment.

    The CBI had filed a case in 1997 against 25 cops allegedly involved in a fake encounter and Ram Singh was one of them. The case was registered by the CBI under Sections 302, 364 and 120B against all 25 accused.

    A bomb blast had occurred in Jalandhar a few years ago and one of the accused Vijay Pal Singh, a terrorist, who was in the custody of the Delhi police, had named three cops Baljit Singh, Rajwinder Singh and Mukhtiar Singh in the incident. The next day, one of the cops Baljit Singh was allegedly killed while the whereabouts of the other two are not known till yet.

    DSP Ram Singh was posted in the Lambra police station when the police tried to recover the arms used in the incident.

    Joga Singh, father of the slain cop Baljit Singh, later filed a writ petition in the Punjab and Haryana High Court following which the court directed the CBI to enquire into the entire incident.

    According to Satnam Singh Kler, counsel for all 25 accused, said that all cops had been sent to judicial custody till December 24.

    Punjab police DGP N P S Aulakh today marked an inquiry to the Additional DGP, Armed Battalion, to ascertain whether the state police had received information that the official gunman of Congress leader Harminder Singh Jassi was under arrest in Mumbai since nearly one month for firing on a Sikh protester during the visit of Dera Sachha Sauda chief Gurmeet Ram Rahim Singh there.

    The DGP, when contacted, said the Additional DGP had also been directed to check why action was not taken on the issue in case information was not received from Mumbai police in the matter.

    Makhan Singh, a gunman of Jassi whose daughter is married to the Dera chief’s son, is at present lodged in the Arthur Road jail for shooting at Sikh protester Balkar Singh during the Dera chief’s visit to Mumbai on June 20.

    The news of his arrest has not been disclosed to the public till now despite the fact that the Sant Samaj and other organisations are protesting against the incident in Chandigarh and other parts of the state since then.

    The DGP said the force faced a problem in ascertaining the movement of its personnel when they were deployed for protection duties. He said in case the protected person chose to send them elsewhere, it was difficult for the organisation to keep check of their movements.

    He said moreover the number of people having gunmen was huge. However, he said, the Punjab police was in the process of evaluating a system whereby it would be able to check misuse of gunmen.

    He said stringent norms, which called for strict action in case of any misdemeanour, were being laid out.

    Makhan Singh, who had been serving with Jassi for some time, is otherwise attached with the 5th Commando battalion of the Punjab Armed Police at Bahadurgarh.

    His parent battalion came to know about his being missing only after Jassi reported that the gunman was missing from duty after he had been arrested in Mumbai.

    Cops at loss to explain Makhan episode

    CHANDIGARH: Yes, Makhan Singh is a commando with Punjab Police, but we know little about how he was attached with Dera Sacha Sauda chief Baba Gurmeet Ram Rahim Singh.

    These were the words of IG commando Iqbal Singh Sahota, who was in charge of the 5 Commando Battalion of the state police, the parent cadre of Makhan.

    However, IG told TOI that the commando was suspended on June 16, after a routine check about the status of commandos. Interestingly, he was the only one who was found absent from duty, a fact, which is hard to buy. However, this fact has put top brass of Punjab Police on the back foot.

    Officials of state police told TOI that Makhan, who was arrested by Mumbai police on June 21 after he allegedly shot at a Sikh protester there, was officially posted with the son-in-law of Baba and Bathinda MLA Harmohinder Singh Jassi.

    Sahota said they were in touch with Mumbai police about the development. He added that a departmental inquiry would be conducted to find out how he managed to be with the Baba.

    "We had counter-checked his continuous absence from duty. Earlier his family used to make excuses that he was busy in the treatment of his mother. He was suspended after prolonged absenteeism," Sahota added.

    ppl watch this debate and let me know wat u think ?? to be it was just a joke calling some acctress from bollywood to talk about sikhism everyone knows these people or any celebrity hav no religion they only think about money...and the host of the show i think wanted to put her opinion on the people rather then letting them give their opinion. she didnt let anyone finish their say or say what they wanted to....and then some sikh historian some lady who doesnt even have her hair, what kinds of research they're going to provid eot the people when they dont know the basic principles of sikhism themselves....

    This was an interesting display of what lack of community education, lack of nationalism and lack of a strong sense of belonging does to people. I am so surprised at the "Sex in the City" liberal thinking of these idiots on this show, who are more obsessed with what the other populations think of them rather then having respect for their own communities viewpoints and beliefs. I was also so shocked at how easily these people accepted the self defense of the late 70's and 80's as extreme acts by the community rather then a necessity of that time.

    I also noted one other thing and that was the youth in this interview did have similar complaints/concerns when it comes to a simplified definition of Sikhism, as others in the Western world.

    Turban/ beard = Sikh Clean shaven = other.

    Other then this the host has this anti-Sikh (Turbaned) agenda and view point. She seems to be someone who has been at one point discouraged when it comes to Sikhism and its traditional practices.

    This is an interesting debate and i think a few points need to be made.

    1) there is some discussion about defining a sikh. There is not one answer and it depends how inclusive or exclusie we want to be. We at ProjectNaad would suggest that every living creature is a sikh....i.e. on a journey to realise truth. The traditional orders (sampardayas) in sikhi such as Nirmalas and Seva Panthis all have people who do not have the form of the Guru yet are 110% sikh

    2) Deras form a very important part of Punjab in terms of provinding social, economic and spiritual services to society. They in fact provide the perfect model for propagating sikh dharma. One of the central reasons for why deras are so popular is the sgpc itself. If you create a Gurdwara in Punjab it comes under the automatic ownership of the sgpc. No one wants this and so people set up deras.

    3) Everyone has the right to practice whatever religion they want in whatever way. So for people who think that Deras should be closed...we would suggest you read the definition of of a Demcracy.

    4) whether a Dera has illegal things going on inside or not is completely insignificant. The first woman president of the SGPC was rumoured to have killed her own daughter...lord knows what happens behind our own closed doors. So lets now point fingers at other peoples oppression or corruption because we are not clean by a long shot.

    5) We should give many condolences and blessings to the innocent person who was caught in this whole thing.

    6) We need to learn be less reactive as a community at the smallest things. This way we dont need to worry about bad press as much because people will not have ammuition against us.

    7) we hear talk of someone impersonating Guru Gobind Singh yet I fail to see how this is disrespectful when khalsa sikhs are supposed to impersonate Guru Gobind SIngh ji in thought, word and deed? Also he did an Amrit ceremnoy with 7 people instead of 5. So what? He isn't asking sikhs to change their ceremonies and in a demcractic state he can practice his brand of spirituality however he chooses and wear whatever clothes he wants.

    8) There was some talk about someone putting a price on the head of the chief of this dera. This kind of talk is extremism and will propagate sikhi to the low depths that Muslims have and continue to take their religion to. We need to completely disassociate ourselves with people who make such statements. Also the Media has a field day when someone talks like this. Under no circumstances should our community be resorting to mass hysteria, death threats etc.

    I think the liberal sikhs in the panel made some excellent points. I was pleantly surprised to hear the wise words of our sikh actress regarding economic and social empowerment. Thats the last time i think that bollywood actors are more beauty than brain!

    reply to 3) why people want to run personal gurudwaras when sgpc is taking responsibility of every gurudwara in punjab, still there r many gurudwaras run by personal group of people. the motive is clear less devotion to religion, more devotion to money that they can earn from 'guru ki golak'. may be the people in sgpc are corrupt, but the protocols on which sgpc is running are correct. every sikh should follow the order of Akal Takht Sahib

    reply to 7) seems u r supporting that <admin-profanity filter activated> gurmeet ram rahim...? ok leave the case which hurt sikh sentiments apart for some time what about other cases:

    a) killing of kamaljeet singh (last year), killing of balbir singh (mumbai), not even a single dera follower is hurt in clash bcoz sikh never want to kill anyone innocent but the culprit shud be punished.

    b) two murder cases registered against dera chief, many murders still unregistered.

    c) hundereds of rape cases against him, few rape victims finally speak out to show the real face of culprit

    d) smuggling of weapons, drugs.

    e) illegal land occupation in sirsa (750 acres), many more such lands.

    Most Deras move you away from Sikhism and this they do by giving you shortcuts. Like you do not need to do Nitnem and they give you Naam etc.

    Deras do not enjoin you with Waheguru like Sikhism does. Deras enjoin you with the Dera head who is more concerned about your pocket and his vote bank power.

    And when you have Sri Guru Granth Sahib Ji what is the need for a Dera?

    This debate on NDTV was one of the silliest debates I have ever seen. They were there debate about the current situation and they started debating who is a Sikh and who is not.

    Just a post for those who might be in two minds about attending the Hyde Park march tomorrow... Here's a post that was made in the gupt section that I thought was relevant in this thread as well. (I hope the person who wrote the post doesn't mind me posting it here too.)

    Sometimes we may not realise what a difference our attendence/support could make to others.

    Everyone please try to attend the march tomorrow if you can spare the time. There are coaches leaving from many different locations (see above for more details.)

    For those who are attending - please take strength from this account and remember, although some might label the march 'pointless' in actual fact it does give strength to people around the world. We will not forget and we will stand united.

    Sorry 4 posting in da gupt section, but my password doesnt seem 2 work and proving 2 be a nigtmare to reset.

    A few weeks ago I met a mate I hadnt seen for a few years. To cut a long story short my friend went to prison a few years ago, he went in as a mona and basically when he came out he took his amrith.

    Anyway we was talking about why he changed and various things.

    He got maried in India and was saying that he met one of his wifes uncles. When he met this uncle , the uncle started crying.

    My freind asked him why are u crying, he basically said that he was so shocked to see a chardikala singh from england. basically he said that he was involved in the freedom movement in the 90's. and that he and his family had sufferd quite bad and that he now lives in hiding in rajasthaaan and very rarely returns to punjaab. The reason that he was crying was because he said we went through so much, we gave up everything 4 our dharam, but the state of punjaab at the momnet makes u think was it worth it. He couldnt believe that sikhi was so strong in england. When my friend told him abt hyde parkand that he had all sant ji's speaches and that we hadnt 4goten the events of the 80's in the uk made him smile and made him believe that all the singhs kurbaniia hadent been 4 nothing.

    My friend was saying that every year he sends him picts of hyde park march and sant ji's speaches and how that singh couldnt believe that we hadnt 4goten.

    My friend was saying that some times when he feels down in his sikhi he just remembers that singh crying and he is back on track again.

    Sometimes we question the little things we may do, like attending programs akandh paats in the remberance of all those that did so much 4 our beutifull sikhi,but the little things can mean so much 4 some people.

    One resident of Amritsar gave an eyewitness account to the

    editor of the Sikh Messenger, a British publication.

    “The army pounding of the Golden Temple area continued over

    the next few days confirming our fears of deliberate and

    vindictive destruction. On the night of the 5th, the aged and

    chronically ill father of the couple next door finally expired and

    on the morning of the 6th the army gave our neighbours

    special permission to take him to the crematorium. Even before

    reaching this site, they could smell the stench of putrid and

    burning flesh. On entering the crematorium grounds they saw

    a sight that literally made them sick with horror. Grotesque piles

    of dozens of bodies were being burnt in the open without

    dignity or religious rites like so many carcasses. The bodies had

    all been brought there by dust carts and from the number of

    carts; the attendant estimated some 3,300 had so far been

    cremated

    Mary Anne Weaver’s report in the Sunday Times

    “Thousands of people have disappeared from the Punjab since

    the siege of the Sikh’s Golden Temple here seven weeks ago. In

    some villages men between 15-35 have been bound,

    blindfolded and taken away. Their

    fate is unknown. Recently in the

    tiny village of Kaimbala, 300 troops

    entered the Sikh Temple during

    prayers, blindfolded the 30

    worshippers and pushed them into

    the streets. According to the priest,

    Sant Pritpal Singh, the villagers

    were given electric shocks and

    interrogated as to the whereabouts

    of Sikh militants. Gurnam Singh, a

    37 year old farmer was held in an

    army camp for 13 days. Last week, his face bruised and his arms

    and legs dotted with burns, he said he had been hung upside

    down and beaten."6

    Media reports

    The Guardian reported the following: “A Sikh doctor drafted

    from the Government hospital to Jullunder to conduct post

    mortem examinations said that he had seen the bodies of two

    Sikhs who had been shot at point blank range, their hands tied

    behind their backs with their turbans. His colleagues had

    reported others, some of whom had been machine-gunned.

    This doctor headed a team that conducted 400 examinations.

    He said that most bodies were riddled with bullets and bore

    bomb wounds. He said, “It was a virtual massacre. A large

    number of women, children and pilgrims were gunned down.”7

    The Guardian went on to report: “Another police official told

    reporters that a lorry load of elderly Sikhs, who surrendered on

    the first day of the military operation, were brought to the main

    city police station and tortured there by the army. “The soldiers

    removed their turbans, pulled their hair over their eyes and tied

    the long hair around their necks. Then they threw sand into

    their faces. The old man shrieked, but I helplessly watched all

    this from my office window.”

    Witnesses depose before CBI court

    Kanwar Singh Dhami and his wife Kulbir Kaur Dhami today made extrajudicial confession in the special court of CBI Jagdeep Jain in the murder case of Ropar-based advocate Kulwant Singh.

    The lawyer, his wife and son were murdered in January, 1993 allegedly by Ajit Singh Sandhu (who has since died), DSP Jaspal Singh, sub-inspector Arvinder Singh and Balwant Singh at police station in Ropar.

    Kulbir Kaur today identified DSP Jaspal Singh in the courtroom. Deposing before the court, Kanwar Singh Dhami stated that he and his wife had been illegally detained by the police when the crime was committed.

    He stated that the accused had allegedly raped advocate Kulwant Singh’s wife and then murdered them.

    Kulbir Kaur stated that during their illegal detention for a year, they overheard other police personnel discussing the crime.

    The two witnesses were cross-examined today. During the cross-examination, they supported the prosecution claim. According to sources, the witnesses had received threat calls from the accused.

    Earlier, another accused Harpreet Singh was arrested for the murder. Subsequently, two accused stated that Harpreet was innocent.

    Thereafter, an application was moved before the Supreme Court and Harpreet was given a clean chit in the case along with a compensation of Rs 10 lakh.

    Nearly 18 years after an ITI student was eliminated by the cops near Khanna, his parents have now gathered evidence in support of their contention that the killing was staged.

    They have finally managed to procure, through the Right to Information (RTI) Act, a copy of an inquiry report that was allegedly kept under cover for so many years.

    Armed with the report, Krishan Singh and Harbans Kaur of Fathegarh Sahib have moved the Punjab and Haryana High Court, seeking a compensation of Rs 5 lakh for the killing of their 19-year-old son Baljit Singh in a fake encounter on June 14, 1990.

    In their petition, placed before the high court division Bench of Justice M.M. Kumar and Justice Sabina, the two have claimed: Bare perusal of the report makes it crystal clear that their son was innocent and killed by the respondent police officials in a fake encounter. The petitioners have added the Punjab government had asked the Ludhiana deputy commissioner to conduct an inquiry after the media and the political parties highlighted the matter.

    A report in the matter was submitted to the authorities concerned, but its contents were not made public. Though time and again they contacted the powers that be for procuring a copy of the report, it was not handed over to them.

    Even efforts to procure the information through the RTI Act did not prove beneficial, initially. An application was moved on May 30, 2007, for the report. But the DC concerned said it had been submitted to the Home Department.

    The petitioner then approached the Home Department. But, nothing came out of it. Eventually, the petitioner moved the Appellate Commission; and on its directions the report was handed over to them.

    Going into the background of the matter, the petitioners added Baljit Singh and friend were riding a scooter when they were apprehended by the respondent police officers near Kotla Ajmer village. The two were, on the direction of then DSP Paramraj Singh, shot. They were then declared dreaded terrorist.

    The entire drama was enacted for promotions, the petitioners alleged. Taking up the petition, the Bench today issued notice of motion to the State of Punjab and the respondent police officials. The case will now come up for hearing on May 27.

    The petitioner then approached the Home Department. But, nothing came out of it. Eventually, the petitioner moved the Appellate Commission; and on its directions the report was handed over to them.

    Going into the background of the matter, the petitioners added Baljit Singh and friend were riding a scooter when they were apprehended by the respondent police officers near Kotla Ajmer village. The two were, on the direction of then DSP Paramraj Singh, shot. They were then declared dreaded terrorist.

    The entire drama was enacted for promotions, the petitioners alleged. Taking up the petition, the Bench today issued notice of motion to the State of Punjab and the respondent police officials. The case will now come up for hearing on May 27.

    Seeking the dismissal of a petition filed by the wife of eliminated human rights activist Jaswant Singh Khalra for directing the Central Bureau of Investigation (CBI) to probe the involvement of Punjab's former director-general of police K.P.S. Gill in the matter, the premier investigating agency today said the plea was devoid of merit.

    In an affidavit submitted before Justice M.M. Kumar and Justice T.P.S. Maan of the Punjab and Haryana High Court on Paramjit Kaur Khalra’s petition, the CBI said, “Investigation did not bring out evidence to substantiate the allegations against Gill”.

    Even the trial court did not find evidence against Gill. As such, no investigation remains to be conducted in the case in respect of conspirators, the CBI added. The case will now come up for further hearing on April 21.

    The petition was filed over 12 years after Jaswant Singh was abducted from his residence before being eliminated.

    In her petition, Paramjit Kaur had asserted “hard evidence” had come on the trial court record about the then DGP Gill's involvement.

    As such, appropriate order be issued to the CBI to further investigate the conspiracy angel and the involvement of the then DGP in abducting, illegally detaining, torturing and murdering Jaswant Singh.

    Describing Gill as the "main accused", she had stated that the results of the investigation should be presented before the CBI court so that "he can be brought to justice". She had added that Gill had "escaped" due to partial and incomplete investigation.

    Going into the circumstances leading to the filing of the petition, she had contended that at least two representations were forwarded to the CBI director for the completion of investigation in the murder case so that Gill could be held accountable, in accordance with law, for his crime.

    International human rights groups also wrote to the CBI director to take up

    the matter.

    It may be recalled that another Division Bench of the High Court, comprising Mr Justice Mehtab Singh Gill and Mr Justice A.N. Jindal, has already held Khalra was "abducted so that his life could be extinguished."

    He was picked up from his house "at the instance of SSP Ajit Singh Sandhu" by DSP Jaspal Singh and other cops, including Satnam Singh, Surinder Pal Singh, Jasbir Singh and Prithipal Singh.

    He was tortured at the Jhabal police station before being shot. Finally, his body was disposed of near the Harike bridge.

    The development assumes significance as witness Kuldeep Singh had reportedly alleged that he had seen Gill go into a room in which Khalra was being kept at Manawala in Taran Tarn.

    Contaminated water has polluted drinking supplies, the study says

    High levels of ground water contamination in the north Indian state of Punjab are causing DNA to mutate in people, according to a study.

    Research over a two-year period found that poisonous pesticides and heavy metals had entered the food chain.

    This had caused a high prevalence of congenital deformities, cancer and kidney damage, the study said.

    It was commissioned by the Punjab Water Pollution Control Board, which told the BBC it was studying the findings.

    Mercury and arsenic

    The report - by a team of senior doctors from the post-graduate Institute of Medical Education in Chandigarh - was conducted over the past two years.

    It linked contaminated water with varying degrees of DNA mutation in people in the state.

    According to the study, 80% of ground water samples had mercury that was far beyond the permissible level.

    Arsenic was found in 70% of samples of effluent, 50% of tap water samples and 57.7% of ground water samples.

    A high degree of pesticides had contaminated water in drains in parts of Ludhiana, Amritsar, Jalandhar and Nawanshahr.

    The study says that blood samples collected from people in the area showed that in 65% of the cases the DNA had mutated.

    Recommendations

    The chairman of the Water Pollution Control Board, Yogesh Goel, told the BBC that the recommendations had to be "debated an discussed".

    Mr Goel said that the "industry was not just to blame, the overuse of pesticides was another reason. We have to ascertain reasons for it".

    Apart from studying the quality of water close to major drains in which effluents were discharged, the study also looked at the health profile of people in settlements close to these drains.

    The pollution control chief said the board would study the report and make its recommendations to the government.

    He said the study had recommended constant monitoring of water supply and sewerage, involvement of village councils in the treatment and disposal of solid waste, and the need for industries to adopt new technology in extracting ground water.

    The state has begun implementing a World Bank project to improve water supply and sanitation in the state.

    New Delhi: Nearly a quarter century after horrific anti-Sikh violence in the national capital left 2,733 innocents dead, just 13 people have been punished in half a dozen murder cases, says a new book.

    “In all other cases, either the police have closed the file or the courts have acquitted the accused. Symbolism assumes greater significance, given the gap between the rhetoric and reality of the rule of law in India,” said the book, “When a Tree Shook Delhi” (Roli). The book hit the stores this week.

    “In a larger perspective, this shows that for all the material progress made by India, its legal culture is still far from developed,” the book said.

    “If the struggle for justice could not secure the conviction of a single political leader or police officer; if so many institutions collapsed during and after the 1984 carnage; if Delhi set a precedent for mass killings in Gujarat, the civil society cannot escape blame for lack of ‘due diligence’, and for neglecting the duty of ‘eternal vigilance’,” it added.

    Authored by journalist Manoj Mitta and advocate H.S. Phoolka, the book takes an overview of the butchery that took place on the streets of New Delhi and elsewhere in the country’s north following the Oct 31, 1984, assassination of prime minister Indira Gandhi at the hands of two of her Sikh bodyguards.

    The book is based mainly on the wealth of evidence that emerged in the course of the Justice G.T. Nanavati Commission of inquiry into the 1984 violence. The report was made public in 2005.

    Besides a journalist’s reconstruction of the terrible killings and destruction of Sikh property in Delhi after Indira Gandhi’s assassination, the book also has a first person account of the struggle for justice by victims of the violence.

    The book praises Maxwell Pereira, who then was deputy head of the Delhi Police north district unit, for ably controlling the violence that erupted outside the Sis Ganj gurudwara on Chandni Chowk in the city’s old quarters, despite having few men with him.

    “Unlike his counterparts in other parts of Delhi, Pereira did not disarm the Sikhs and leave them at the mercy of the mobs. Instead, he persuaded them to go inside the gurudwara by promising to provide them security. He kept his word and dealt with the mobs sternly despite having a meagre force at his command.

    “It took a lot of courage and ingenuity to do so. Once he got the Sikhs to go indoors, the mobs from both directions were emboldened to pelt stones with greater vigour. All that Pereira and his men could do in return was threaten to fire with their revolvers.

    “In a gritty display of policing, they managed to keep the crowd at a safe distance from the gurdwara till a small reinforcement came along with tear smoke ammunition.”

    When the officer saw a mob looting a watch shop owned by a Sikh at Chandni Chowk, he ordered his men to fire at the miscreants. A constable fired three rounds, killing one rioter instantly.

    “Driving home the rule of law, Pereira announced then and there a reward of Rs. 200 to the constable, making sure the reward was heard by everyone as he announced it on a loud hailer. The firing and the reward had the desired - and expected - effect. Sis Ganj Gurudwara was saved as the mobs melted away.”

    The book refers to the apology to the Sikh community and the nation Prime Minister Manmohan Singh tendered in parliament over the 1984 violence.

    “It is no credit, however, to the Indian democracy that it took so long for the government to apologise in the parliament for a massacre of Sikhs and that it finally took a Sikh prime minister to do so.

    “Whatever the circumstances, the symbolic value of Manmohan Singh’s apology cannot be underestimated. It is in keeping with the spirit of ‘truth and reconciliation’ catching on in the world.”

    Victims of 1984 riots hold demonstration, seek justice

    Victims of the anti-Sikh riots of 1984 staged a demonstration in the capital on Wednesday seeking the arrest of those still at large despite committing heinous acts of crime against their community.

    A large number of victims and their family members, including women and children, assembled at the memorial of Mahatma Gandhi at Rajghat and marched towards the Supreme Court to air their grievances.

    They shouted slogans against Prime Minister Manmohan Singh, Congress president Sonia Gandhi and Congress leaders Jagdish Tytler and Sajjan Kumar.

    According to the protestors, around 10,000 of those accused in various cases of rioting and worse are still roaming freely in Delhi and no action has been taken against them.

    The spokesperson of the All India Sikh Conference, Gurcharan Singh Babbar, said: "We want the Supreme Court to answer for its failure in taking any action in the case of the perpetrators of the violence of 1984."

    "If the Supreme Court can take cognisance of issues like the spread of dengue in Delhi, sealing of commercial enterprises being run from residential premises, the fodder scam of Bihar and pollution in the Yamuna, isn't the matter of Sikhs important enough for it to take action?"

    Babbar said that 5,327 members of the Sikh community were killed in Delhi in the violence that followed the assassination of former prime minister Indira Gandhi on Oct 31, 1984.

    The protestors carried placards with slogans like "Is sealing more important than 10,000 killers", "How will Indian judiciary prove its credibility about 1984 carnage" and "We have lost faith in the judicial system".

    The protestors demanded that all the accused in the 1984 riots cases who are still roaming free be booked and action taken against them. They wanted the government to be made a party in the case in order to ensure its accountability.

    Babbar said: "We want that all the affidavits filed before various commissions set up to look into the matter and the reports of these commissions be put before the Supreme Court so that it may take up the matter in a proper manner."

    When asked about the Rs 75 billion package announced by the government last year for the victims of the 1984 violence, Babbar said: "The question today is not of relief. We are not talking of relief. We are talking of justice. We want it soon."

    He claimed that the victims are facing lots of problems in claiming economic relief on account of bureaucratic procedures.

    A delegation of the protestors submitted a petition enlisting their problems to the registrar of the Supreme Court.

    Speaking for the first time after the fresh revelations on the post-Godhra riots, Congress president Sonia Gandhi today made an oblique reference to the 2002 communal carnage witnessed in Gujarat, reaffirming that the party will not make this issue the centrepiece of its campaign in the December assembly polls.

    Speaking at a special function to give away the Indira Gandhi Rashtriya Ekta award, referred indirectly to the new revelations on Gujarat Chief Minister Narendra Modi’s role in the riots without naming Modi. Complimenting the award winners, Sonia Gandhi remarked that the expose had proved that Dr J.S.Bandookwala and Prof Ram Puniyani had chosen the right path in working selflessly for the cause of secularism and national integration.

    She exhorted every Congressman to emulate their example, stating that it is their prime responsibility and duty to launch a determined battle against such barbarism. “If we do not fight against such anti-social forces firmly, it could prove fatal for the secular and democratic fabric of this nation,” the Congress president added.

    Since this was Congress president’s first public address after the recent revelations, there had been considerable speculation about how she would pitch this issue, especialy since Gujarat assembly polls are little over a month away and Dr Bandookwala was being awarded for his work during the Gujarat riots.

    Senior Congress leaders were at pains to explain that the party president could not be expected to use harsh or abusive language at an award-giving function, adding that her brief but pointed reference to the Gujarat riots and Modi’s communal agenda had effectively conveyed her strong views on the issue.

    The Congress president is expected to set the tone for the party’s election campaign at a mahila rally she is scheduled to address at Anand on November 3.

    Party strategists maintain they will not focus solely on the the Gujarat riots in their election campaign but will broadbase it to include Modi’s poor record as an administrator, his failure to deliver on the development front and corruption and scams plaguing his government. “The 2002 violence will be one of the issues we will focus on,” remarked a Gujarat Congress leader. There is an underlying fear in the party that there could be a Hindu consolidation in the BJP’s favour if the Congress makes the communal violence as its main election plank.

    “Although 85 per cent of the riot victims in Delhi have been paid the monetary part of the compensation, the government is yet to give them the promised employment,” advocate Harvinder Singh Phoolka said.“What is worse is the fact that the government appears to be backing out from implementing its promise of giving a liberal package in some states,” Phoolka told IANS.He identified three such states - Rajasthan, West Bengal and Tamil Nadu.Phoolka, who has been fighting for justice on behalf of the Sikhs who had suffered in 1984, is planning to move the Supreme Court to force the government to implement its promise of enhanced compensation across the country.Violence directed at innocent Sikhs, after two of her Sikh bodyguards shot dead then Prime Minister Indira Gandhi on this day in 1984, which left 2,733 people dead in the Capital, by the official count. Besides, many were injured.In 2006, Dr Manmohan Singh had promised a liberal compensation to the riot victims.     Hundreds of Sikhs took out a march from Rajghat to the Supreme Court today, seeking the arrest of those involved in the 1984 anti-Sikh carnage.

    It is hoped that the Supreme Court would consider their petition seriously. It would try to provide justice to them as soon as possible, BJP Delhi unit president Harsh Vardhan said.

    He said if the guilty persons of the anti-Sikh riots started on this very day 24 years ago were not punished even now, the Sikh community would stop trusting the law and order system of India.

    More than 3,500 Sikhs were killed in Delhi during the riots. Lakhs of families were rendered homeless. The carnage which started on October 31, 1984, in Delhi after the assassination of Indira Gandhi, continued for three days and the police remained silent spectators. Till now, 10 enquiries had been completed after that incident, but the main accused of the Congress were still roaming free, said Vardhan.

    The BJP Delhi unit president said the then central government avoided constituting an enquiry even after six months of the riots. After much delay, the Ranganath Mishra Commission was constituted. Its report was submitted after 23 years, yet the Sikhs could not get justice. Forty-two cases of murder of Sikhs had not been started in the courts as yet. Thousands of sufferers had been deprived of the compensation, pointed out Vardhan.

    The Delhi government has tried ‘half-heartedly’ to heal the wounds of the Sikhs. It does not seem to have intention to do justice to the Sikhs.

    He said when the governments and the courts did not provide justice, the people were compelled to take the law into their own hands. In a democratic system, there are great expectations from the judiciary and the media, Vardhan said.

  17. ASI acquitted in Khalra murder case

    Appeals and revision petitions filed in the Khalra murder case today culminated with a division Bench of the Punjab and Haryana High Court acquitting ASI Amarjit Singh, while maintaining that the conviction of DSP Jaspal Singh along with four other policemen Satnam Singh, Surinder Pal Singh, Jasbir Singh and Prithipal Singh.

    Pronouncing the orders in an open court, the Bench comprising Justice Mehtab Singh Gill and Justice A.N. Jindal held: “We do not find any infirmity in the judgement of the trial court, apart from the conviction of appellant ASI Amarjit Singh. The appeal of ASI Amarjit Singh is accepted and he is acquitted of the charges framed against him. If in custody, he shall be set free forthwith”.

    He, along with DSP Jaspal Singh, was sentenced to life imprisonment by Patiala’s Additional Sessions Judge on November 18, 2005, under Sections 302 and 34 of the IPC after being convicted for the murder of human rights activist Jaswant Singh Khalra. The other accused were sentenced to five years of imprisonment.

    In its detailed order, the Bench ruled: “Taking the statement of witnesses in totality, we have no hesitation in coming to the conclusion that Jaswant Singh Khalra was picked up from his house at the instance of SSP Ajit Singh Sandhu by appellants Jaspal Singh, Satnam Singh, Surinder Pal Singh, Jasbir Singh and Prithipal Singh. He was tortured at Jhabal police station and shot dead there. Finally, they disposed of his body near the Harike Bridge on the Sutlej.”

    The Bench added: “A number of defence witnesses have been examined. Their testimony and veracity were gone into, but ultimately it comes out that they were untruthful witnesses, who were going out of the way to help the appellants. Advocate Gurjit Singh Kahlon went out of the way to procure a false affidavit under threat from prosecution witness Kuldeep Singh.

    Speaking for the Bench, Justice Gill observed that the motive behind the commission of offence had been spelt out not just by one, but a number of witnesses, Justice A.S. Bains included.

    The Judge further observed: “All these witnesses have stated that Khalra was a human rights activist and was looking into the deaths of innocent persons, who had been killed in false encounters and their bodies cremated in the districts of Amritsar and Tarn Taran.”

    Justice Gill added: “Kuldeep Singh is the star witness…. We find his statement to be truthful, convincing and inspiring confidence. He initially was under fear, but at a later stage came out with the truth. He is an eyewitness to the gruesome abduction, murder and disposal of Khalra’s body.

    It may be recalled that witness Kuldeep Singh is a former special police officer and was reportedly recruited into the police force by former Tarn Taran SSP Ajit Singh Sandhu.

    Private publishing of birs banned

    District magistrate Kahan Singh Pannu today imposed prohibitory orders under Section 144 in Amritsar district to ban publication of birs of Guru Granth Sahib by private publishers.

    The orders have been issued three days after the incident in which activists of the Guru Granth Sahib Satkar Committee blackened the faces of two sons of publishers Jeewan Singh Chattar Singh in public.

    Talking to The Tribune, Pannu said he had imposed the ban orders after holding discussions with representatives of various Sikh organisations. He said the orders would be effective for a month. However, the SGPC or any other organisation authorised by the SGPC had been excluded from the orders.

    The state government is also likely to issue a notification banning the publication and selling of Guru Granth Sahib, except by the SGPC, shortly. General secretary of the SGPC Sukhdev Singh Bhaur said the SGPC was contemplating establishing a modern printing press in Mohali. The state government had also decided to approach the Central government to make a law under which action could be taken against a person who tries to publish the holy book without permission of the SGPC.

    Publishers go underground, victims booked

    Even as owners of Jeewan Singh Chattar Singh, the oldest publishers of Guru Granth Sahib, have gone underground, fearing yet another attack by activists of Guru Granth Sahib Satkar Committee, the district police chief has recommended imposition of Section 144 in the surroundings of the publishing house to stop sale of Guru Granth Sahib in future.

    The recommendation to impose ban orders has been recommended by the district police chief to the dstrict magistrate.

    All 15 members of the publishers have gone to an unknown place as they were asked by the police not to open their shop till further orders.

    Meanwhile, the police today registered a case against the victims. However, the police spared the activists of the committee who had attacked the sons of the publisher on the reported direct intervention of Chief Minister Parkash Singh Badal.

    The victims had sent missives to the President of India, Prime Minister, union home minister and human rights commission against the “excesses:” committed on them.

    The buyer, Swinder Singh, was produced in the court of duty magistrate Harjit Singh Khalsa and sent in police remand for two days. However, the two brothers who were taken into police custody yesterday are yet to be produced in a court. All three persons were accused of hurting the religious sentiments.

    Meanwhile, deputy commissioner Kahan Singh Pannu said he had also received a complaint from the publishing house.

  20. Mistaken identity or fake encounter?

    In what could be yet another case of mistaken identity or a planned fake encounter, the sister of a victim here today claimed that the actual “militant” the police claimed to have killed was still alive.

    Lakhbir Kaur alleged that the police killed her brother, Kinder Singh, who was an innocent truck driver, on August 13, 1993, for no reason. Interestingly, Jaspal Singh, who had an award of Rs 5 lakh on his head and was shown killed in police files, was still alive. He was present with Lakhbir Kaur here today.

    Addressing a press conference, Col G.S. Sandhu, chairman of the Majha Ex-Servicemen Human Rights Front, demanded a probe by a retired high court judge to bring out the truth of fake encounters so that compensation could be given to the families of the victims.

    “Kinder Singh of Nagoke (20) was pulled out of a truck in Shivpuri, Madhya Pradesh, and shot dead. The story planted was that militant Jaspal Singh of Nangli, carrying a reward of Rs 5 lakh, was shot in a police encounter. Kunan Singh, father of Kinder Singh, sold his 3 acres of land and shifted to UP and the family is now living in abject poverty,” said Colonel Sandhu.

    “Already, leaks from police sources suggest that Kinder Singh and Sukhpal Singh of Kala Afghana were killed as a result of mistaken identity as no reward money was claimed and the records being old have been destroyed as per laid down rules and now it is difficult to pinpoint responsibility at this stage. The issue is why the families of the two victims were not informed about their deaths,” he questioned.

    Colonel Sandhu demanded “the state should not shy away from admitting past mistakes, render apology, provide compensation and bring the guilty to the book.” He also sought downsizing of the top-heavy police in Punjab. He has also started a terror helpline in Tarn Taran (9876169922).

    Trouble in store for erring cops

    The fresh investigations into fake encounters that began soon after three militants resurfaced long after the police claimed to have eliminated them is now threatening to snowball into a major issue of concern for the Punjab Police.

    Several police officials, who claimed cash rewards and were awarded police medals for supposedly having “killed” these very militants could be in trouble.

    Well-placed sources in the police have stated out that the ongoing probe is expected to reveal startling facts about how some unscrupulous policemen used the system to kill innocents and pass them off as militants, who in those times used to carrying a big cash reward on their heads; also, how these cops went onto claiming promotions on the basis of fake killings, all this while misleading the state.

    Sources said the identity of the people who were ‘bumped-off’ to show the elimination of Gurnam Singh Bandala, Gurcharan Singh Giani (a younger brother of Khalistan Commando Force supremo Surjit Singh Painta) and Jaspal Singh Bhatti, had been established.

    It was after these three militants resurfaced early this year that a probe was ordered into the fake killings. Now, the reports filtering out indicate that the police records collected by the investigating officers show that the FIRs and the postmortem reports do exist, but these relate to the deaths of other people and not these militants.

    Police teams would now be sent to Madhya Pradesh where one such fake encounter took place.
