Lok Nayak Bhawan (5th floor) Khan Market , New Delhi..110003 Subject:- Reconstruction of Gurdwara Gyan Godrhi Sahib at Har ki Pauri, Haridwar, which was earlier taken over by the Haridwar Municipal Committee. Reference – Our Representation of 2000 and in reply to that, the Commission’s Interim Decisions :- A) Allocation of some land at another place on the banks of Ganga, for the constuction of a Gurdwara . Installing a memorial playcard exactly at the same place, where the Gurdwara Gyan Godri existed, indicating the historical event of the visit of Guru Nanak Dev ji to Haridwar and the significance of the place and installing a Nishan Sahib at that point. ..P/2 -2- Sir, With great reverance, it is brought to your kind notice that we had a fair hope that your above mentioned Interem Decisions would be implimented very soon, the matter being related to deprivation of the Rights of a Minority Community ( i.e. Sikh Community) and safeguards, provided in the Constitution of India and Laws of the Country, for which the Commission is fully empowered by the Parliament to monitor the working of rights and safeguards the affected Minority Community. But even on elapsing of eleven (11) years of time, no positive results have been achieved on the subject matter, though it is very important issue which have deep feelings and religious sentiments of a Minority Community. ( i.e. Sikh Community) at large since long. 2. The Commision’s Interim Decision is a package deal and it can not/ should not be implemented in a piece meal. 3. However, on a partial issue (i.e. allotment of land at another place for constuction of Gurdwara), some correspondence ( enlisted below) has been exchanged regarding land owned by Irrigation Deptt., (Western side of Cannal and North of by-pass Road.), which is situated at Ranipur Morh, Haridwar. Later on, it was revealed that this land is related to Uttar Pradesh Govt. and not to the Uttranchal Govt. i) D.O. No. CH/1 (2) 2003-NCM dated. 17 Sep. 2003 from Shri Tarlochan Singh, Chairman, National Comission for Minorities, Govt. of India, New Delhi to the President, Gurdwara Gyan Godri Parbandhak Committee, Haridwar alongwith a copy of letter No. 22/ S.T. dated. 16 Aug. 2003 from the District Magistrate, Haridwar to the Secretary, National Commission for Minorities, Govt. of India, New Delhi. ii) Letter No. GGG/03 dated. 28/29 Sep. 2003 from the President , Gurdwara Gyan Godri Parbandhak Committee, Haridwar to the Chairman, National Commission for Minorities, New Delhi. iii) Letter No. FN.S /29/32/3-00-NCM dt 08 Oct. 2003 from Shri Gurbachan Singh, Joint Secretary, Govt. of India, National Commission for Minorities New Delhi to the District Magistrate, Haridwar, with a copy to Shri Subhash Kumar, Commissionar Garhwal, Uttranchal and to the President Gurdwara ……..P/3 -3- Gyan Godri Parbandhak Committee, Panchpuri, Haridwar . Uttranchal State . iv) D.O. No. S/29/32/3/00-NCM dt. 22 Dec. 2003 from Shri Gurbachan Singh, Joint Secretary , Govt. of India. National Commission for Minorities to Shri V.K. Dewan, Chief Secretary, Govt. of Uttar Pradesh, Lucknow, with a copy to (1) Shri. R.S. Tolia, Chief Secretary, Govt. of Uttranchal, Dehradun, (2) Shri S.K. Maheshwari, District Magistrate, Haridwar, Uttranchal, (3) Sr, Harjeet Singh Dua, President Gurdwara Gyan Godri Parbandhak Committee, Panchpuri, Haridwar, Uttranchal State. v) Leter No. GGG/016 dated. 14-03-2005 from Shri Harjeet Singh Dua, President, Gurdwara Gyan Godri Parbandhak Committee, Haridwar to Shri Gurbachan Singh, Joint Secretary N.C.M. , New Delhi, with a copy to Shri Tarlochan Singh, Chairman, N.C.M., New Delhi. In this letter, it was pionted out that “the Chief Engineer, (Ganges), Meerut, (U.P.) has sent comments on three points, proposed by D.M., Haridwar to the Irrigation Secretary, Lucknow (U.P.). On point 2 , he has indicated in his above report that this land has been given to Forest Department for plantation, on actual visit to site it is seen that no such plantation has been done”. vi) Letter No. HO/GGG/02/06 dt. 14-02-2006 from the President, Gurdwara Gyan Godari Parbandhak Committee, Panchpuri, Haridwar to the Chief Secretary, Govt. of Uttar Pradesh, Lucknow, with a copy to the Chairman, National Commission for Minorities, New Delhi and to the Chief Secretary. Govt, of Uttranchal, Dehradun. vii) Letter No, …… dated 19-06-2007 from the President, Gurdwara Gyan Godri Parbandhak Committee, Haridwar, to the Chief Secretary, Govt. of Uttar Pradesh, Lucknow with a copy to (1). Chief Engineer and Head of Deptt., Irrigation Deptt., Planning Section, Yamuna Colony, Dehradun and (2) S.E. (Irrigation), Works Section, Near Ujwal Bhawan, Maharani Bagh, G.M.S. Road, Dehradun. (Uttranchal.) Even on sending numerious communications / reminders to the Chief …… P/4 -4- Secretary, Uttar .Pradesh. Lucknow, there is not a single word reply or any assurance from him, the question of allotment of land for the purpose is a matter of far away. The Chief Secretary of Uttar Pradesh Lucknow and the Chief Secretary, Uttrakhand, Dehradun did not feel it nessessary even to acknowledge any of our letters. The issue has been considered as an ordinary matter by both the Governments of Uttrakhand and Uttar Prasesh and their subordinate authorities. 4. It is very strange and pitty to say that the Govt. of Uttrakhand is totally silent to implement Commition’s Interim Decision regarding “installing a memorial playcard exactly at the same place where the Gurdwara Gyan Godri existed, indicating the historical event of the visit of Guru Nanak Dev ji to Haridwar and the significance of the place and installing Nishan Sahib at that piont (i.e. at Har ki Pauri, Haridwar, the existed Gurdwara place) which was earlier taken over by the Haridwar Municipal Committee.” This decision may please be got implemented immediately at the same place ( where the Gurdwara was existed is under the administrative control of the Govt.of Uttarakhand. 5. In view of the above, it is requested that the long pending issues may kindly be taken up at top priority with the Govts. of Uttrakhand and Uttar Pradesh and may be settelled immediately ( i.e. within a stipulated time ) and this may not be allowed to linger on any more for the years togather, which may create more complications for the settellment of this sensitive important matter. 6. From the above stated facts and circumestances, it is crystle clear that both the Govts. of Uttrakhand and Uttar Pradesh have violated the desision / orders of the Commission, which may kindly be treated as “Contempt of Court.” as the Commission have the powers of a “Civil Court”. 7. It may also kindly be considered that it is our right to get the Gurdwara Gyan Godari re-constructed at the same place, “Har ki Pauri” where the old Gurdwara was existing . We have already represented and requested to your goodself for the ….P/5 -5- same in the year 2000. And the National Commission for Minorities is quite empowered to safeguard our rights and there may not be a question, “ that the present situation at Har ki Pauri on the banks of the Ganga is such that the re-establishment of the Gurdwara at the same place would not be possible” , as per contention of District Magistrate, Haridwar. The background of the same may please be clarified / made clear to us, as the Sikh Community had a Gurdwara at that place since long time, (i.e. Centuries back). and all revenue records etc. are also available as such there is no dispute with any other party. 8. Now the patience of Sikh Sangat has run out and you are quite aware from the news papers/ media etc. that we are making our full efforts for the peaceful possession of the site in question and settelment of the issue, as in the past few years a large number of masses of Sikh Community gathered at Haridwar and memorandums have been submitted from time to the local Adminisration at Haridwar as well as to the Governor, Chief Minister and other Governmental authorities of Uttrakhand ( previously Uttranchal) but of no use as all this was in vain. 9.In case, the issue is not settelled by the concered authorities at the earliest, the matter will be left over to the public recource ( i.e. Sikh Sangat and Khalsa Panth ) for taking further necessary action / steps to achieve the same place of Gurudwara Sahib related to the historic visit of Sri Guru Nanak Dev ji to Haridwar.(Har ki Pauri), which is vey sacred place and have a great significance for all deciples of Sri Guru Nanak Dev ji.
