  1. Just came across this photo with the following caption: On 11 Sep 1990 CBI team raided Sajjan Kumar's house to arrest him. As the team went in, a "mob" blocked exit points, CBI team was only allowed to leave once High Court in an emergency hearing granted anticipatory bail to Sajjan Kumar. The team barely escaped death, their vehicles were attacked and all papers were torn. Sajjan Kumar's supporters celebrated their victory by dancing on the smashed CBI car in the picture. In Mr. HS Phoolka's words, the incident showed "the immense influence, political clout, and criminal mindset".

NEW DELHI: Nearly three decades after Prime Minister Indira Gandhi's assassination triggered riots that killed thousands of Sikhs, Congress leader Sajjan Kumar will face trial for his alleged role in a murder in Delhi's Sultanpuri area. The Supreme Court on Tuesday dismissed a petition by Kumar and another co-accused challenging the trial court's decision three-and-a-half years ago to frame murder charges against them. The Delhi High Court too had rejected Kumar's plea against the trial court order. In July 2010, the trial court framed charges under several provisions of Indian Penal Code including Section 302 (murder) and rioting against Kumar, Brahmanand Gupta, Peru, Khushal Singh and Ved Prakash Pial for their alleged role in the killing of a man in Sultanpuri area during the anti-Sikh riots. Khushal Singh died during pendency of the case. A bench of Justices A K Patnaik and V Gopala Gowda dismissed the appeals filed by Kumar and Brahmanand Gupta after the CBI opposed their pleas on the ground that the HC, after going through the evidence, had found that the trial court had strong suspicion about their involvement in the crime. However, the HC had rejected a plea for framing "conspiracy" charge against the accused. The CBI will challenge before Delhi High Court the acquittal of Congress leader Sajjan Kumar in a 1984 anti-Sikh riots case by a city court as it has found "strong grounds" which could form basis of its petition. CBI sources said here today that the agency is likely to wait till the court pronounces its verdict on the quantum of sentence for those found guilty in the case. District and Sessions Judge JR Aryan had on April 30 acquitted Kumar in the 29-year-old case in which he was accused of murder and of instigating a riotous mob that killed five Sikhs in Delhi's cantonment area. Five others — Balwan Khokkar, an ex-councillor, Mahender Yadav, an ex-MLA, Kishan Khokkar, Girdhari Lal and Captain Bhagmal — were convicted for their involvement in the riots that had broken out after the assassination of the then Prime Minister Indira Gandhi on October 31, 1984. Kumar, a former Lok Sabha MP from Outer Delhi who was refused a Congress ticket for the 2009 Lok Sabha elections, still faces a trial in another 1984 rioting case. In a third case, the Delhi Police have filed a closure report, saying there was no evidence against Kumar to implicate him. His acquittal has led to protests by Sikh outfits in the national capital and in parts of Punjab. The riots victims gathered outside the Karkardooma Court complex here and shouted slogans demanding justice for them and their family members who were killed in the riots. They were raising slogans seeking strict punishment for Tytler and Congress leader Sajjan Kumar, who is facing trial for his alleged role in instigating the mob to kill Sikhs after the assassination of the then Prime Minister Indira Gandhi on October 31, 1984. During the hearing, the court directed CBI prosecutor, who sought more time for advancing his arguments as he was not prepared today, to begin his arguments on the next date of hearing on March 20, failing which the judge said she would pass the order in the case on the basis of available evidence. "If the arguments are not advanced by CBI on March 20, the next date of hearing, the order will be passed on the basis of material available on record," Additional Sessions Judge Anuradha Shukla Bhardwaj said. The court was hearing final arguments on the protest petition filed by riot victim Lakhwinder Kaur, whose husband Badal Singh was killed in the riots, challenging the CBI's closure report and clean chit to Tytler in the case. The case was fixed for today for CBI's arguments as on the last date of hearing the prosecutor was not available while senior advocate H S Phoolka and advocate Kamna Vohra, appearing for the victims, had concluded their arguments. CBI prosecutor Sanjay Kumar said he has been handed over the charge of the case file recently so was not fully prepared to argue. The judge asked the prosecutor what was the problem and why he cannot argue when the CBI officials were told earlier also that the case has been fixed for their submissions.
