The following was authored by a concerned Canadian Sikh academic, who wrote under the condition of anonymity, in rebuttal to Jonathan Kay’s piece, entitled “Why are some Canadian Sikhs expressing solidarity with an unrepentant terrorist?“ There are many questions surrounding the stay of execution of of Balwant Singh Rajoana, who was sentenced for his involvement in the 1995 assassination of Beant Singh — the former chief minister of Punjab who spear headed the genocide against Sikhs in the region. But Rajoana’s sentence has since been stayed. Beant Singh gave police officers the authority to carry-out extrajudicial executions, targeting and killing civilian Sikhs on the spot. This led to fake “encounter” killings, illegal detention, torture and rape. Beginning in 1984, and continuing until his assassination, an estimated 9,000-30,000 Sikhs were murdered in Punjab. During Beant Singh’s reign, thousands of Sikhs were killed for being “suspicious,” despite claims that there were only approximately 300 armed Nationalist Sikhs. After the death of Beant Singh in 1995, the senseless murders of Sikhs stopped. Why is the Sikh population displaying insurmountable support and rallying to stop the execution of Rajoana, who many consider a terrorist? The fact of the matter is that Sikhs do not support terrorists or terrorism, but are looking for equal treatment and justice in the so-called secular democracy known as India. Sikhs and Muslims are minorities in India and are often jailed without a court hearing, not allowed to fight their cases, given more severe penalties than their non-Sikh inmates, and given longer jail terms and intentionally delayed sentences. In 1984, tens of thousands of Sikhs were killed in riots in Delhi that were believed to be led by accused Indian politicians Kumar and Tytler, but due to “technicalities,” their cases have been stayed. These riots happened almost 30 years ago, but these people are allowed to walk free. In 2003, accused politician Modi, started riots that led to the killings of thousands of Muslims in Gujarat. To this day, he walks free. The minority Sikhs have long been oppressed by the Indian government. Corruption and discrimination have plagued Rajoana’s case and, as a result, there has been an outcry for justice. It is often said that there is no justice for Sikh prisoners in India. By displaying their support for Rajoana, Sikhs are expressing their desire that a single standard be applied to all people in India. Rajoana has always accepted responsibility for his crime and refused an appeal. He accepts the death penalty. People are simply arguing that the government should not hang Rajoana, until they hang other people who have committed similar crimes — to show the same commitment to human rights and the rule of law when the Indian state, its forces, its bureaucrats and its politicians commit heinous crimes against humanity. The inconsistencies are too harsh to ignore. Kishori Lal, the “Butcher of Trilokpuri,” was released following three death sentences for going on a Sikh murdering spree in 1984. Today, many police officers and politicians who committed human rights violations and were involved in the Sikh genocide live freely and have worked their way up the political ladder. It appears the only fate for a Sikh political prisoner is the hangman’s noose. There are numerous other legitimate reasons why Rajoana should not be executed: There are 2 other Sikh men who were involved in the killing, their trials are still pending (conveniently still in jail and awaiting fair trial for 17 years). So how can one man be hung when the other cases are not officially over. There is an ongoing explosives case on Rajoana in Patiala Court; the Advocate General can issue a writ to the court to suspend the hanging until the pending case is solved. Rajoana was not the actual murderer of Beant Singh (the murderer died in the bombing); he was a conspirator. So why is he being executed after spending 17 years in jail? You must ask yourself, are these these actions consistent with the values of a liberal democracy? Would you not be upset? This is precisely why the Sikh population around the world is joining hands and supporting Rajoana. To us, Rajoana is a freedom fighter whose intent was not to kill innocents, but rather criminals, and to bring justice to Punjab. If someone had successfully killed Hitler, would that man be considered a terrorist? Maybe by Hitler supporters. When All Hopes of addressing a wrong had failed, Rajoana was left with no alternative. He did what the Indian government failed, or chose not, to do: He stopped the violence in Punjab! Rajoana and others took matters into their own hands, took down a tyrant and allowed the state of Punjab to live in peace. If you wish to try Rajoana and hang him, you must hand down the same sentence to the many other men who murdered Sikhs in cold blood. I am a Sikh and we do not support terrorism. The Sikhs of Canada and around the world support Rajoana for ridding the world of an evil man. The population would not be opposed to the death penalty handed out to Rajoana, had the others been tried just as equally. Forward this to your ignorant teachers, There is an incident about the sardar's and 12 o clock this is the story that my friend told me: "I was standing at dadar station when my attention went towards a Sikh youth standing near me wearing a Black turban having a long beard and wearing a kirpan over his shirt. After a while, one local train arrived, which was totally packed. The Sikh youth tried to alight the train but failed to do so. Just then a voice was heard from the back coach 'Sardarji Barah Baj gaye' (Sir it's 12 o'clock!) The Sikh youth looked ! over at that voice maker who was a young Mischievous type of person and instead of showing any anger made a smile towards him. The smile made was so enigmatic that it seemed as if some type of truth lies behind it. Not able to resist my temptation, I walked towards him and asked why did he smile at that person who teased him. The Sikh youth replied, 'He was not teasing me but was asking for my Help'. I was surprised with these words and he told me that there was a big history behind that which one should know. I was eager to know the History and the Sikh youth narrated: During 17th Century, when Hindustan was ruled by Mughals, all the Hindu people were humiliated and were treated like animals. Mughals treated the Hindu women as there own property and were forcing all Hindus to accept Islam and even used to kill the people if they were refusing to accept.That time, our ninth Guru, Sri Guru Teg Bahadarji came forward,in response to a request of some Kashmir Pandits to fight against all these cruel activities. Guruji told the Mughal emperor that if he could succeed in converting him to Islam, all the Hindus would accept the same. But, if he failed, he should stop all those activities. The Mughal emperor happily agreed to that but even after lots of torture to Guruji and his fellow members he failed to convert him to Islam and Guruji along with his other four fellow members, were torture! d and sacrificed their lives in Chandni Chowk. Since the Mughals were unable to convert them to Islam they were assassinated. Thus Guruji sacrificed his life for the protection of Hindu religion. Can anybody lay down his life and that too for the protection of another religion? This is the reason he is still remembered as "Hind KiChaddar", shield of India . For the sake of whom he had sacrificed his life, none of the them came forward to lift his body, fearing that they would also be assassinated . Seeing this incident our 10th Guruji, Sri Guru Gobind Singhji (Son of Guru Teg Bahadarji) founder of khalsa made a resolution that he would convert his followers to such human beings who would not be able to hide themselves and could be easily located in thousands. At the start, the Sikhs were very few in numbers as they were fighting against the Mughal emperors. At that time, Nadir Shah raided Delhi in the year 1739 and looted Hindustan and was carrying lot of Hindustan treasures and nearly 2200 Hindu women along with him. The news spread like a fire and was heard by Sardar Jassa Singh who was the Commander of the Sikh army at that time. He decided to attack Nadir Shah's Kafila on the same midnight . He did so and rescued all the Hindu women and they were safely sent to their homes. It didn't happen only once but thereafter whenever any Abdaalis or Iranis had attacked and looted Hindustan and were trying to carry the treasures and Hindu women along with them for selling them in Abdal markets, the Sikh army although fewer in numbers but were brave hearted and attacked them at midnight ,12 O'clock and rescued women. After that time when there occurred a similar incidence, people started to contact the Sikh army for their help and Sikhs used to attack the raider's at Midnight , 12 O'clock . Nowadays, these "smart people" and some Sikh enemies who are afraid of Sikhs, have spread these words that at 12 O'clock , the Sikhs go out of their senses. This historic fact was the reason which made me smile over that person as I thought that his Mother or Sister would be in trouble and wants my help and was reminding me by saying off "Sardarji Barah Baj Gaye' ." New Delhi March 31: The Home Ministry will examine on merit the mercy petition of Balwant Singh Rajoana, sentenced to death for assassination of former Punjab Chief Minister Beant Singh, and it will be submitted to the President for a final decision. Home Minister P Chidambaram said Rajoana's mercy petition filed by Shiromani Gurudwara Prabhandhak Committee and the Delhi Sikh Gurudwara Management Committee had come to the Home Ministry two days ago and had been added to the list of mercy petitions of condemned prisoners. "We will examine it on merit and submit to the President of India," he said. Chidambaram said the execution of a condemned prisoner had to be stayed once a mercy petition is filed before the President and that it should be kept in abeyance till a decision was taken on the prayer. He said guidelines in this regard were very clear. Once a mercy petition is filed on behalf of a sentenced prisoner, the sentence cannot be executed unless there is a decision on the mercy petition. "So, when we got the copy of the mercy petition (of Rajoana) from the President's Secretariat, we immediately drew the attention of the government of Punjab to the standing guidelines and the instructions "By drawing the attention of government of Punjab to the standing guidelines and instructions, does not mean the Home Ministry is expressing any opinion on the merits of the mercy petition," he said. The Home Minister refused to comment on alleged politics being played on Rajoana's mercy petition but said a mercy petition filed on behalf of a condemned prisoner should be treated equally like the mercy petition filed by a condemned prisoner. Chidambaram said during his tenure as a Home Minister, he had received 33 mercy petitions and all but one had been submitted to the President for decisions. "I think all mercy petitions are submitted, re-submitted to the President. There is only one mercy petition that is pending in the Ministry out of the total of 33, including what I got after I took over," he said. He said 32 mercy petitions had been submitted or re-submitted to the President and that the President had taken a decision in 15 cases which is a record -- record for any President or for any period of three years. Saturday, March 31, 2012 - 21:00 By Sukhwinder Malhi GURDASPUR: Standoff between the Gurdaspur district administration and parents between Gurdaspur District administration and family members of Jaspal Singh, student of Beant College of Engineering, who was killed in police firing ended on Saturday evening with the government ordering suspension of Gurdaspur SSP Varinder Paul Singh and DSP Manpreet singh and transferred Gurdaspur Deputy Commissioner Mohinder Singh Kainth. Talking to Punjab Newsline ADGP (Law and Order) S. K. Sharma said on Saturday with the suspension of the SSP and DSP and transfer of DC , the parents of Jaspal Singh and Sikh organisation had agreed for cremation of the body. Sharma said the body of Jaspal Singh was cremated after Sikh organisations agreed for cremation following the government action against the SSP and DSP and the DC. While the parents of the deceased backed by leaders of various Sikh organisation were refusing to cremated the body till their three demands were met which included suspension of Gurdaspur SSP, criminal cases against DSP and ASI who had ordered firing and arrest of 14 Shiv Sena activists, who were involved in violence during the bandh in Gurdaspur which was called to protest against death penalty to Balwant Singh Rajoana . on March 28 .However, the curfew in thecity continued for the third day on Saturday with uneasy calm prevailing in the city the cremation could take place only after the government conceded to the demands of Sikh organisations Gurdaspur Deputy Commissioner Mohinder Singh Kainth assured parents of Jaspal Singh and leaders of the Sikh organsiations gathered at Sidwan village native place of Jaspal singh, the protesters said they would allow cremation of the body only if the government showed them the written orderes of the government conceding their demands. While Akal Takh chief Jathedar Gurcharan Singh, Damdami Taksal Head Baba Harnam singh and leaders of other various Sikh organisations were still camping at Sidhwan village to make common cause with the aggrived family of Jaspal Singh for the second day today, they had been adamant on their three demands. The father of the deceased, Gurcharan Singh had been maintaing that the body of Jaspal Singh will not be cremated till the police officials involved in firing were not booked and the SSP was suspended. Earlier on Friday evening ADGP Sharma, who is camping here since the firing took place had told media persons that the police have registered an FIR against unidentified persons for firing and the district administration has suspended Naib Tehsildar S. L. Salwan for mishandling the situation which led to firing the Sikh organisations have also been demanding arrest of 12 Shiv Sena activists who were involved in violence on March 28, Gurdaspur Deputy Commissioner Mohinder Singh said, cremation took place after he held meeting with holding meeting with parents of the devised and Sikh organisation leaders gathered at Sidhwan village to persuade them for early cremation of body of Jaspal Singh as the body was likely to decompose to rising temptations during the day , the parents of the deceased and Sikh organisations felt satisfied by the Government action against guilty cops involved in firing . ADGP Sharma said while the curfew was relaxed on Saturday morning for two hour the curfew will continue till there was peace till law and ordered situation improved in the city.
