In seeking U.S. asylum, he now lives a nightmare By MARY JO MELONE, Times Staff Writer Published September 15, 2004 Before Tuesday, I had never talked to anyone held by that scary new federal agency, the Department of Homeland Security. But then Paramvir Singh Chattwal called. He said he wants to die. Chattwal has been in DHS' detention facility at the Manatee County jail since last October. From the moment he got there, he has been fighting to be saved from the very country he once thought would be his refuge. Chattwal sought political asylum in the United States, saying he had endured threats, torture and detention in his native India. He is a member of the Sikh faith, a minority in India and for years the target of oppression by the Hindu majority. When he was a teenager, Chattwal said, he witnessed the police execution of four other young men. To keep his silence, they detained him. He was beaten, subjected to electric shock, submerged in near-boiling water, burned with cigarettes, hung upside down and left for dead. Chattwal came to the United States and hired a lawyer for his asylum request in 2000. Bureaucratic failure after failure followed, he said when we talked Tuesday. He said the Immigration and Naturalization Service never told his attorney the date of his asylum hearing. It was held anyway, and when Chattwal failed to show, a deportation order was issued. That order somehow never reached him. Chattwal said he assumed the asylum process was still going on, and moved around the country, working the odd jobs that illegal immigrants often take - in hotels, a convenience store. He even worked as a stable hand. Years passed. He took a Florida vacation and was caught speeding in Venice. When police ran a check on his name, his deportation order popped up. He was promptly sent to Homeland Security's Bradenton detention center. Chattwal's case has been taken up by the Florida Center for Survivors of Torture and Refugee Services in Clearwater as well as Amnesty International USA. They want to know why the government is so bent on deporting Chattwal, despite the fact that he's no danger to anybody, and certainly not a security threat. He never has had a hearing on his asylum request at which he was present. One judge ordered the case reopened, only to have another judge close it. The Canadian government offered to take in Chattwal, but the Department of Homeland Security said no. The prospect of returning to India has plunged him into despair. He thinks of killing himself in jail. "If you have the choice of being tortured and killed and ending your own life, what would you choose?" he said when we spoke by phone. "I don't think I can go through it again. People accused of crime in this country get a trial ... What wrong did I do?" The Department of Homeland Security, working through a smaller agency called Immigration and Customs Enforcement, has taken over the duties of INS. The new agency has a chilling name: ICE. It has shown Chattwal no mercy. An agency spokesperson wouldn't explain to the St. Petersburg Times why he isn't being allowed to go to Canada. Chattwal said he never heard about his asylum hearing, but the agency said he had his chance, didn't appear, and the law has been followed. He lost there and has lost since. Chattwal lost for what may be the last time Tuesday, when a federal appeals court refused to stop his deportation. When I spoke to him again after the court ruling, he talked through tears. "I'm absolutely devastated," he said. "I just pray God come down and save me or take my life." The news also stunn ed the people who have worked on his behalf. "We've tried everything to save this man's life," said Niki L. Kelly from the Florida Center for Survivors of Torture and Refugee Services. Chattwal said his family has told him authorities will be waiting for him when he gets off the plane in New Dehli and he'll be whisked off to God knows where. He fully expects to never be heard from again. Such a horror, and yet I'm afraid many people here won't side with Chattwal. In a post 9/11 world, sympathy is in short supply, even though this country was built on being a beacon for people like Chattwal. When we lost our sense of safety did we lose our sense of decency too?

PunjabiPredator, Well from what I recall from the various books on Sikh history I have read is that it was the Jinnah's Muslim League that called for a day of action against all Kafirs (non-muslims) in Punjab that kicked the riots between Sikhs + Hindus verses Muslims. It was that S.O.B (pardon my french) that called for a seperate nation state for muslims which led the Sikh delegation to raise their demand for a seperate nation state (Punjab, Khalistan, Sikhistan). So dont tell me that muslims are friends with Sikhs....they are friends unto themselves only. Sure we can live in peace with them as brothers....when all is said and done but that will only happen when they change their agenda of Islamic domination. As for all these Z-class elitie protection for murderers of Sikhs believe me....a determined individual can do almost anything. There is no such thing as perfect security, if these so called Khalistani's from Pakistan wanted to prove they are doing something to bring justice to the Sikhs. Yeah would have happened sooner or later. The way Indira "Hitler" Gandhi was going on she would have wiped out all Sikhs from India with gradually increase in harressment, attacks, murder, ridicual. The pakistani's real long term aim is to grab Kashmir for itself or make it independant as long as it is a muslim country. Our strategy, as Sikhs worldwide, at the moment must be to wait and see approach. Pakistan is not very stable itself and if a civil war was to brake out it then it would provide the right time to for freedom fighters to liberate punjab from Islamic hold on punjab. But the biggest hurdle is international politics, until the situation changes and this mences of al-qaeda and taliban are not defeated. The USA administration will continue to lend support to Pakistan even though it does so with gritted teeth.

What can I say he was the greatest Sikh leader of modern times. Stayed true to his word and fought against the enemies of Sikhism never running away from the battlefield, giving his life up while defending sri harmandir sahib. The most imporantant and lasting contribution he has made is not in life but in death. Hardly anyone knew about him and his mission prior to operation blue star. Now every Sikh youth who wants to quit drugs, smoking, alcohol, etc can look at Sant Bhindranwale as a lion role model. We can also look back at history, read relevant articles and see the facts from the lies and propaganda the Indian govt had spread about him and his followers. Brother Deep Singh, I know that a member wrote what she (Kim Bolan) claims but there are so many members here who write extraordinary and fantasy stuff that no one takes them seriously. How many other forums online has this Kim Bolan investigated? Why does she constantly monitor Sikh forums when there are radical islamic and racist neo-nazi ones which are activicly recruiting for members to fight against the western way of life and the world system as we know it. Sikhs love the west and pose absoulately no danger to it. Lets remind these ignorant people in the west that our brave people fought for their freedom from the nazi's. When we could have used the man power and resources to fight for own nation state or reclaim the lost lands of the Sikh empire/kingdom. Khalistan in any shape or form can wait, our faith and people must come first.

I have read the full article and had a suspicion that the ignorant stupid lazy racist, one Kim Bolan, was behind the article. The amount of venom this woman has against Sikh's is unbelievable. She claims that someone from the forum wants to start a minor babber Khalsa group. Who in there right mind thinks that idea is logical or viable in the current climate and world opinion. If Babber Khalsa is involved in terrorism then it should be banned and rightly so and any other group that is involved in the killings of innocent peoples. But lets not forget that various terrorist groups around the world are allowed to operate freely and pose a much bigger threat to world peace than any Sikh Speratist group could ever. Sikhs want the right to be free and to rule themselves in their own homeland Punjab / Khalistan. Self-determination and freedom is our birth right and more important for us guru given rights. Unlike other groups fighting for independance Sikhs fight on the basis of equality of human race regadless of skin colour, gender, religion, caste,etc. Most Sikhs want to see a democratic sovereign nation state so they be proud of their nation and feel safe to like anmd work in. Who are these white / chrisitian / atheists ,etc think they are in dictacting what terrorism is good or not. Many of their groups are heavily involved in terror and are plungged the world in chaos to bring about their new world order. Why isn't KKK, Combat 18, CIA, VHP, Shiv Sena, RSS, etc listed as terror groups as they funded to actively couducted operations that are terror related. Enough is enough we need to form action groups to combat the un-called attacks by racists in the media and in positions of power.

We need to keep a close eye on these so called "aryan" nazi terrorist organisations because the threat posed by them is greater than that of any other in the west. Recent cases and events have shown they are getting a growing membership of racist scum.
