The Right to Self-Determination is enshrined in the UN Covenant on Civil and Political Rights and the Covenant on Economic, Social, and Cultural Rights. Further, articles 18 & 19 of the Universal Declaration of Human Rights-1948 provide for the right for free speech. Article 19 states:-

"Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas, through any media..."

This right is also provided under article 19 of the Indian Constitution.

HOWEVER...

"Simranjit Singh Mann was arrested for sedition with other senior Dal Khalsa leaders for delivering a speech in which he and ten others made demands for a Khalistan buffer state between India and Pakistan."

"The Amnesty International Secretariat are expected to make a public announcement calling for Amnesty to be given immediate access to Panjab to investigate, which they have been denied since 1978."

EVEN THOUGH...

The Supreme Court of India, when quashing a conviction in Balwant Singh vs State of Punjab (1995) held that ‘the mere asking for Khalistan’ is not an offence.
