The Sikh Federation (UK) in collaboration with Sikh organisations throughout Europe is organising the first ever European Sikh Lobby Day.

The SIKH FREEDOM LOBBY will be taking place in Brussels on the afternoon of Wednesday 31 May 2006 from 12 noon.

The four freedom issues to be covered are:

- the freedom of Professor Davinderpal Singh Bhullar and other Sikh political prisoners languishing in Indian jails

- the freedom of Sikhs in Europe to practice their faith

- the freedom to expose the genocide of Sikhs in 1984 and the widespread abuse of human rights in India

- the freedom for Sikhs to exercise their right to self determination

Freedom of Professor Davinderpal Singh Bhullar and other Sikh political prisoners

Written Declaration 0030/2006 on the punitive treatment of political and human rights activists in India concerns the case of Professor Davinderpal Singh Bhullar and is reproduced below. The Written Declaration was tabled yesterday and will be an important focus for the lobby.

Sikhs throughout the 25-member EU Member States are encouraged to immediately contact their MEPs and urge them to sign Written Declaration 0030/2006 and also ask their MEPs to get other MEPs belonging to the same EU political grouping to support the declaration.

The Written Declaration will remain open for 90 days until the 26 July 2006, but we need to work together over the next four weeks and at the SIKH FREEDOM LOBBY to try and get the maximum number of MEPs to sign the declaration to put pressure on India.

On 26 May 2006 Professor Davinderpal will be 42-years old having spent the last quarter of his life in prison in India. We owe it to such political prisoners to do all we can to secure their release.

Freedom of Sikhs in Europe to practice their faith

Religious freedoms are a major concern for Sikhs living in Europe. For the last couple of years the right to wear the dastaar in France with respect to school children and when obtaining documentation, such as passports and driving licences have been well publicised. However, similar problems exist for school children in Belgium and difficulties have also occurred in Germany.

The right to wear the Kirpan is facing increasing challenge in many countries throughout Europe and is likely to become more problematic due to security considerations.

Recently a delegation of MEPs has returned from Panjab and promised to take the dastaar issue up with the French authorities. The SIKH FREEDOM LOBBY is an ideal opportunity for Sikhs from across Europe to unite and demonstrate our opposition to all restrictions on our articles of faith.

Freedom to expose the genocide of Sikhs in 1984 and the widespread abuse of human rights in India

International human rights groups such as Amnesty International and the UN Rapporteur on Torture have been prevented from entering Panjab for over 25 years. There are still over one hundred known Sikh political prisoners that are being held without trial or on fabricated charges. Sikh human rights activists that have tried to expose human rights abuses, such as torture, fake encounters and disappearances have met with the same fate.

The Indian authorities have recently admitted they sponsored the killing of innocent people in Panjab to create an atmosphere for the police to allow them to use excessive force, stage fake encounters, torture and disappear at will, use extortion and kill anyone that dared associate with the Sikh independence movement.

As Sikhs in countries across the world are making preparations to mark the 22nd anniversary of the June 1984 massacre the SIKH FREEDOM LOBBY in Brussels provides an excellent political platform for Sikhs from across Europe to exert political pressure on India to allow the international community to learn the truth of 1984 and the events of the last 25 years and seek the justice Sikhs deserve.

Freedom for Sikhs to exercise their right to self determination

12 months ago a paper was presented to UK Parliamentarians titled "Self determination as a human right and its applicability to the Sikhs". This started a debate with UK politicians on why Sikhs believe it is legitimate for Sikhs to have the right to self determination.

The Sikh Federation (UK) has argued there must be an open dialogue with Sikhs on their right to self determination and that the "territorial integrity" of India can not be used as an excuse if politicians believe in the principles that have been established at the UN.

Politicians that apply the territorial integrity "limitation" to India have been reminded:

• The limitation only applies where “States conduct themselves in compliance with the principle of equal rights and self-determination" - India opted out of this defence in 1966 when they put down a "reservation" when ratifying the International Covenant on Civil and Political Rights. India in effect stated in the UN that the right of self determination only applied to people living outside India. France, Germany and the Netherlands objected to the reservation on the grounds self determination must apply to ALL people. The UN has invited India to withdraw this reservation, but India has neglected to respond.

• It is now internationally recognised that any government which is oppressive to peoples within its territory may no longer be able to rely on the ground of ‘territorial integrity’ as a limitation on the right of self-determination.

The SIKH FREEDOM LOBBY in Brussels will allow Sikhs for the first time to engage at the European level on the importance of the Sikh right to self determination and why organisations, such as the Sikh Federation (UK) passionately believe in the establishment of an independent sovereign Sikh State, Khalistan.

Actions to be taken:

1) Contact your MEPs and ask them to sign Written Declaration 0030/2006.

2) Arrange to take part in the SIKH FREEDOM LOBBY in Brussels on Wednesday 31 May. You need to contact your MEP and ask for a brief lobbying meeting. It will work best to operate as a 'country' delegation so everyone from country is signed in by MEPs from the respective country

Written declaration on the punitive treatment of political and human rights activists in parts of India

The European Parliament,

– having regard to Rule 116 of its Rules of Procedure,

A. whereas Devinderpal Singh Bhullar has been incarcerated in India for 11 years, following deportation from Germany on 17 January 1995 in a move declared illegal by the Court of Appeal in Frankfurt,

B. whereas he had earlier fled Panjaab due to intense political persecution,

C. whereas he has been subjected to torture whilst in Indian custody and faced a contentious trial, resulting in a death sentence,

D. whereas Amnesty International and other human rights groups have raised concerns about Devinderpal's draconian treatment by India's authorities,

1. Calls on the Commission and the German Government to press for an immediate withdrawal of the death sentence imposed on Devinderpal, and to demand a full review of his case in accordance with international law, under monitoring by UN observers;

2. Calls on the Commission and Council to demand that India cease its punitive treatment of political and human rights activists in Panjaab, Kashmir, Nagaland and other areas of major political unrest;

3. Instructs its President to forward this declaration, together with the names of the signatories, to the Council, the Commission, the Government of Germany and the Government of India.

SIKH FEDERATION (UK) ANNOUNCE FIRST EVER SIKH FREEDOM LOBBY IN EUROPEAN PARLIAMENT

The Sikh Federation (UK) in collaboration with Sikh organisations throughout Europe is organising the first ever European Sikh Lobby Day. The 'SIKH FREEDOM LOBBY' will be taking place in Brussels on the afternoon of Wednesday 31 May 2006 from 12 noon.

- the freedom of Sikhs in Europe to practice their faith

To coincide with the lobby Written Declaration 0030/2006 was tabled in the European Parliament last week on the punitive treatment of political and human rights activists in India. The Written Declaration concerns the case of Professor Davinderpal Singh Bhullar and will be an important focus for the lobby. There are still over one hundred known Sikh political prisoners that are still being held without trial or on fabricated charges.

The declaration while referring to the Professor mentions his illegal deportation from Germany, the intense political persecution he suffered in Panjab, the torture he was subjected to and the contentious trial and death sentence imposed. It calls on the European Commission and the German Government to press for an immediate withdrawal of the death sentence imposed and to demand a full review of the Professor's case in accordance with international law, under monitoring by UN observers. It also calls on the European Commission and Council to demand that India cease its punitive treatment of political and human rights activists in areas of political unrest.

Sikhs throughout the 25-member EU Member States have been encouraged to contact their MEPs and urge them to sign Written Declaration 0030/2006. In addition, MEPs are being urged to get other MEPs belonging to the same EU political grouping to support the declaration.

Sikhs will make a further push on getting signatories at the Sikh Freedom Lobby at the end of the month. On 26 May 2006 Professor Davinderpal Singh will be 42-years old having spent the last quarter of his life in prison and over half his life facing persecution.

The freedom of Sikhs in Europe to visibly practice their faith is a major concern for Sikhs living in Europe. With the 22nd anniversary of the June 1984 genocide of Sikhs fast approaching the third freedom issue to be raised in Brussels will be the freedom for groups like Amnesty International and the UN Rapporteur on Torture to have full access to Panjab to expose human rights abuses.

Amnesty International has now been prevented from entering Panjab for over 25 years. Sikh human rights activists that have tried to expose human rights abuses, such as torture, fake encounters and disappearances have met with the same fate. Given the French, German and Dutch support for the right to self determination it will be important that Sikhs from these countries attend in large numbers.

The Sikh Federation (UK) has appealed to Sikhs across Europe to contact MEPs and ask them to sign Written Declaration 0030/2006. It has asked for each country in Europe where Sikhs live to organise an appropriately sized delegation to ask for a brief lobbying meeting with MEPs on the Sikh Freedom Lobby in Brussels on Wednesday 31 May. In the UK MEPs are split into twelve regions. The aim is to have a delegation of five to ten Sikhs from each region with a regional co-ordinator ensuring all MEPs in the region are contacted and MEPs are aware of all Sikhs attending for each region. Similar arrangements are likely in other countries where MEPs represent regions and a sufficient number of Sikhs are able to attend.

Britons should back oppressed minorities (that means us, too)

On Wednesday, David Cameron was asked who his political hero was. Intriguingly, he named the unifier of Italy, Giuseppe Garibaldi.

It was a revealing moment. While one or two UKIP dunderheads have cavilled at his choice of a foreign republican, thinking Euro-sceptics have been overjoyed.

For Garibaldi was perhaps the supreme exemplar of the doctrine of liberal nationalism, that generous creed that championed the rights of all peoples, not just one's own.

If Mr Cameron is drawing his inspiration from the greatest advocate of the nation state, the implications are colossal.

Until now, the British Right has lacked a holistic view of international affairs - what the Germans call a Weltanschauung, a conception of the world.

In other English-speaking countries, conservatives spend a good deal of time talking about foreign policy, and much of their electoral appeal derives from the fact that they are trusted on the big, global issues. But what do Britain's Tories stand for? They are broadly pro-Washington, broadly anti-Brussels and, er, that's it.

Oddly, even the Conservatives' opposition to European integration - the one part of their foreign policy platform that is familiar to, and shared by, most voters - does not translate into support at the ballot box.

I suspect that the reason for this is that the Tories have not extrapolated from their distrust of the European Union. There is a respectable intellectual case to be made for national self-determination, but the Conservatives have so far been reluctant to make it - let alone extend it to other continents.

In consequence, their Euro-scepticism can come across as stubborn and nostalgic rather than high-minded and generous.

The idea that different peoples should be free to live under their own laws and institutions used to form the basis of Britain's foreign policy.

Canning, arguably the greatest of all Tory foreign secretaries, applied this philosophy, not only to Europe, but to the whole world, using the Royal Navy to guarantee the independence of the fledgling South American republics.

During the 19th century, Britain sponsored national movements in the Low Countries, Greece, Hungary and Italy. During the 20th, it joined two ruinous wars because the sovereignty of another nation had been violated.

These are not just matters of historical interest. The case for national self-determination is as strong today as it has ever been.

Yugoslavia and the USSR fell apart for the same reason as the Ottoman and Habsburg empires: they were arbitrary, multinational polities. The moment their constituent peoples were given the vote, they cast it in favour of self-rule.

Accountable democracy demands that people feel enough in common one with another to accept government from each other's hands.

Take away the demos, the community with which we identify when we use the word "we", and you are left only with the kratos, the power of a state that must compel obedience by force, because it cannot appeal to civic patriotism.

What would it mean if the Conservatives were to infer general principles from their Euro-scepticism? Plainly, as with any policy, dogma would be tempered by realism: no one is going to invade China in order to secure Tibetan independence.

But a Garibaldian foreign policy would mean some radical changes. Instead of seeking to hold Iraq together at almost any price, for example, liberal nationalists would look more kindly on the idea of a peaceable partition following referendums.

Instead of imposing colonial rule on Bosnia and Kosovo so as to ensure their territorial integrity, Garibaldians would allow the component parts of those territories to separate, if that is what their inhabitants chose.

A consistent application of this precept would address a complaint frequently made by Muslims, at home and abroad, namely that Britain's foreign policy is hypocritical.

For while the national principle would make us sympathetic to Zionism - and, indeed, to Israel's desire to impose ethnographic frontiers - it would also lead us to support other causes favoured by Muslims, notably those of the Chechens and the Kashmiris (as well the Turkish Cypriots who, for some reason, are usually overlooked by their co-religionists).

Equally, it would provide a context to our concerns about religious fundamentalism. A liberal nationalist is naturally suspicious of any ideology that presumes to override territorial jurisidiction, whether that ideology is Jacobinism, communism, fascism or Islamism.

It goes without saying that these are complicated issues. People are capable of sustaining multiple loyalties. Populations can be so distributed as to make a clean partition impossible. But a general sympathy, other things being equal, towards national units would revolutionise existing foreign policy.

For our current stance is almost the precise opposite of favouring self-determination. We oppose separatist movements on grounds of defending recognised borders; we elevate the multi-ethnic state as a desirable end in itself; we encourage regional integration, on the EU model, around the world.

There is a reason why Britain does these things, and it is that we have effectively surrendered our diplomacy to Brussels. The EU is founded on the assumption that national loyalties are arbitrary, transient and ultimately discreditable; and, naturally enough, it seeks to export its own ideology.

It is true that, when it comes to the big questions - whether or not to invade Iraq, for example - Britain is still autonomous. But when it comes to the medium-sized ones - whether to sell arms to Beijing, whether to engage with the ayatollahs in Teheran, whether to back anti-Castro dissidents in Cuba, whether to fund the Palestinian Authority - a common EU foreign policy is already up and running.

Go to any non-European capital and you will find that the European Commission's mission dwarfs any of the national embassies. And the chief goal of these Euro-diplomats is generally to encourage the locals to federate with their neighbours, in mimicry of the EU.

Recovering our foreign policy from Brussels should not be an end in itself, but a means to an end. An independent United Kingdom would be free to pursue a very different international agenda, one more in tune with human nature.

Where the EU believes in ever-closer union, Britain should push for its opposite: the devolution of power to the lowest practicable level. Where the EU is fond of international law codes and technocracies, Britain should recognise that countries are generally best run by their own elected representatives. Where the EU regards the nation state as anachronistic, Britain should see it as the optimum forum for democracy.

It was this thinking that, in 1939, led Britain to fight for the cause of all Europe's nations.

Our fathers believed that the patriotism of free peoples formed a natural bulwark against tyranny. You might call that approach irrational, or even outdated. But don't dare call it selfish.

SIKH FREEDOM LOBBY IN EUROPEAN PARLIAMENT

31 MAY 2006 FROM 12 NOON

1. The Sikh Federation (UK) in collaboration with Sikh organisations throughout Europe is organising the first ever European Sikh Lobby Day. The 'SIKH FREEDOM LOBBY' will be taking place in Brussels on the afternoon of Wednesday 31 May 2006 from 12 noon.

2. The four freedom issues to be covered are:

• the freedom of Professor Davinderpal Singh Bhullar and other Sikh political prisoners languishing in Indian jails

• the freedom of Sikhs in Europe to practice their faith

• the freedom to expose the genocide of Sikhs in 1984 and the widespread abuse of human rights in India

• the freedom for Sikhs to exercise their right to self determination

3. To coincide with the lobby Written Declaration 0030/2006 has been tabled in the European Parliament on the punitive treatment of political and human rights activists in India. The Written Declaration concerns the case of Professor Davinderpal Singh Bhullar and will be an important focus for the lobby. There are still over one hundred known Sikh political prisoners that are still being held without trial or on fabricated charges.

4. The declaration while referring to the Professor mentions his illegal deportation from Germany, the intense political persecution he suffered in Panjab, the torture he was subjected to and the contentious trial and death sentence imposed. It calls on the European Commission and the German Government to press for an immediate withdrawal of the death sentence imposed and to demand a full review of the Professor's case in accordance with international law, under monitoring by UN observers. It also calls on the European Commission and Council to demand that India cease its punitive treatment of political and human rights activists in areas of political unrest.

5. Sikhs throughout the 25-member EU Member States have been encouraged to contact their MEPs and urge them to sign Written Declaration 0030/2006. In addition, MEPs are being urged to get other MEPs belonging to the same EU political grouping to support the declaration.

6. Sikhs will make a further push on getting signatories at the Sikh Freedom Lobby at the end of the month. On 26 May 2006 Professor Davinderpal Singh will be 42-years old having spent the last quarter of his life in prison and over half his life facing persecution.

7. The freedom of Sikhs in Europe to visibly practice their faith is a major concern for Sikhs living in Europe. For the last couple of years the right to wear the Sikh turban (dastaar) in France with respect to school children and when obtaining documentation, such as passports and driving licences have been well publicised. However, similar problems exist for school children in Belgium and difficulties have also occurred in Germany. In addition, the right to wear the Kirpan is increasingly being challenged in many countries throughout Europe.

8. Recently a delegation of MEPs has returned from Panjab and promised to take the dastaar issue up with the French authorities. The Sikh Freedom Lobby will provide an ideal opportunity for Sikhs from across Europe to unite and demonstrate our opposition to all restrictions on our articles of faith.

9. With the 22nd anniversary of the June 1984 genocide of Sikhs fast approaching the third freedom issue to be raised in Brussels will be the freedom for groups like Amnesty International and the UN Rapporteur on Torture to have full access to Panjab to expose human rights abuses.

10. Amnesty International has now been prevented from entering Panjab for over 25 years. Sikh human rights activists that have tried to expose human rights abuses, such as torture, fake encounters and disappearances have met with the same fate. The Indian authorities have recently admitted they sponsored the killing of innocent people in Panjab to create an atmosphere for the police to allow them to use excessive force, stage fake encounters, torture and disappear at will, use extortion and kill anyone that dared associate with the Sikh independence movement.

11. As Sikhs in countries across the world are making preparations to mark the 22nd anniversary of the June 1984 massacre the Sikh Freedom Lobby in Brussels provides an excellent political platform for Sikhs from across Europe to exert political pressure on India to allow the international community to learn the truth of 1984 and the events of the last 25 years and seek the justice Sikhs deserve.

12. The fourth and final issue that will be raised is the freedom for Sikhs to exercise their right to self determination. Twelve months ago a paper was presented to UK Parliamentarians titled "Self determination as a human right and its applicability to the Sikhs". This started a debate with UK politicians on why Sikhs believe it is legitimate for Sikhs to have the right to self determination.

13. The Sikh Federation (UK) has argued there must be an open dialogue with Sikhs on their right to self determination and that the "territorial integrity" of India can not be used as an excuse if politicians believe in the principles that have been established at the UN.

14. Politicians that apply the territorial integrity "limitation" to India have been reminded:

• The limitation only applies where “States conduct themselves in compliance with the principle of equal rights and self-determination" - India opted out of this defence in 1966 when they put down a "reservation" when ratifying the International Covenant on Civil and Political Rights. India in effect stated in the UN that the right of self determination only applied to people living outside India. France, Germany and the Netherlands objected to the reservation on the grounds self determination must apply to all people. The UN has invited India to withdraw this reservation, but India has neglected to respond.

• It is now internationally recognised that any government which is oppressive to peoples within its territory may no longer be able to rely on the ground of ‘territorial integrity’ as a limitation on the right of self-determination.

15. The Sikh Freedom Lobby in Brussels will allow Sikhs for the first time to engage at the European level on the importance of the Sikh right to self determination and why organisations, such as the Sikh Federation (UK) passionately believe in the establishment of an independent sovereign Sikh State, Khalistan. Given the French, German and Dutch support for the right to self determination it will be important that Sikhs from these countries attend in large numbers.

16. The Sikh Federation (UK) appeals to Sikhs across Europe to contact MEPs and ask them to sign Written Declaration 0030/2006. It asks Sikhs in each country in Europe where they live to organise an appropriately sized delegation to ask for a brief lobbying meeting with MEPs on the Sikh Freedom Lobby in Brussels on Wednesday 31 May. In the UK MEPs are split into twelve regions. The aim is to have a delegation of five to ten Sikhs from each region with a regional co-ordinator ensuring all MEPs in the region are contacted and MEPs are aware of all Sikhs attending for each region. Similar arrangements are likely in other countries where MEPs represent regions and a sufficient number of Sikhs are able to attend.
