The Rajya Sabha today unanimously passed an amendment to the Anand Karaj Marriage Act 1909, paving the way for separate registration of Sikh marriages.

This meets the 63-year-old demand of the community that so far gets its marriages registered under the Hindu Marriage Act 1955. The Anand Marriage (Amendment) Bill 2012 is expected to be tabled in the Lok Sabha tomorrow and once it clears the final hurdle — it should keeping in mind the consensus — it will become a law. The amendment to the marriage laws was introduced on May 7.

Shiromani Akali Dal members Sukhdev Singh Dhindsa and Balwinder Singh Bhunder praised the Prime Minister for this move and demanded the amendment of Article 25 of the Constitution, which hinders Sikhs from having a distinct identity. At present, Sikhs are clubbed with Hindus under the Constitution and the amendment in Article 25 has been one of the major demands of the community.

Speaking for the Congress, MS Gill lavished praise on the PM while Avinash Rai Khanna welcomed the move. Avtar Singh Karimpuri (BSP), Naresh Aggarwal (SP) and Kanwardeep Singh (TMC) welcomed the move and supported it on behalf of their parties. Dhindsa, Bhunder, and Karimpuri spoke in Punjabi.

Naresh Gujral of the SAD suggested that Law Minister Salman Khurshid issue instructions that Sikh couples who had earlier registered their marriages under the Hindu Marriage Act be allowed to register under the new law.

Once it becomes a law, it will help millions of Non Resident Indians. As of now, marriages registration certificates of NRIs term them as Hindus while their passports define them as Sikhs, resulting in confusion and rejection in visas.

The new Act does not have a provision for divorce as the Sikh clergy could not arrive at a consensus on the issue. The opinion among Sikhs is that the divorce clause could be added later, if the need be.

Parsis, Christians and Muslims already have separate laws for the registration of marriages under their own customs. The Sikh wedding is distinctive from a Hindu wedding and is called an ‘Anand Karaj’. The number of circumambulations (pheras) in Sikh weddings is lesser than those in Hindu weddings. The Sikh priest reads out from the verses from the Guru Granth Sahib.

Sikh couples that get their marriages registered under the Anand Karaj Marriage Act “shall not be required to get their marriages registered under the registration of Births, marriages and Deaths Act, 1969 or any other law for the time being in force (including state Acts)”.

The Anand Marriage Act was promulgated during British times, but was not adopted at the time of framing of the Constitution of Independent India.

u and i all kno this means absolutly nothing!!

if its passed, then we want ALL rights as sikhs, not some token tatti rubbish gestures just 2 keep us quiet. Wat about funeral registrations? wat about the constitution, which STILL states sikhs r keshdhari hindus, guys dont get excited over nutin.

Too late for me. I have to live with the shame of having a piece of paper that says I'm a Hindu who has had a Hindu marriage. India has only done this now because they have been 'shamed' into doing it by Pakistan.

But lets get this new law straight : A Sikh can get married under Sikh Law.....but if he or she wants a divorce they still have to go to court and state they are hindus because they can only get divorced under Hindu Law ?

Have I read the new law correct ?

If u actually bothered 2 study this rubbish gesture from indian govt 2 pass the anand karaj act, tell me wats the point, wen the funeral rights r still under hindu law! Like WestLondonSingh mentioned, the divorce laws r still under hindu law, we r still called hindus under the constitution, yet as far as I kno, pakistan has given us the full package! Until we get the full package, then there is nutin 2 get excited about.

If you don't agree, think about this: If you were a trader and started off in China with silk that cost 100 rupees and came to India, and you had to pay total 800 rupees taxes at every small kingdom along the way, and then sold your goods for 1000 rupees, you'd have 100 rupees left, right? If your daswandh is on the gross, that's 100 rupees, meaning you have nothing left. Obviously, you owe only 10% of 100, not 10% of 1000. No, it's 10% before bills and other expenses. These expenses are not your expenses to earn money. They are consumption. If you are a business owner, you take out all expenses, including rent, shop electricity, cost of goods sold, advertising, and government taxes. Whatever is left is your profit and you owe 10% of that.  If you are an employee, you are also entitled to deduct the cost of earning money. That would be government taxes. Everything else is consumption.

Pause. p611 Here Guru ji shows the importance of both Bani and Naam: ਆਇਓ ਸੁਨਨ ਪੜਨ ਕਉ ਬਾਣੀ ॥ ਨਾਮੁ ਵਿਸਾਰਿ ਲਗਹਿ ਅਨ ਲਾਲਚਿ ਬਿਰਥਾ ਜਨਮੁ ਪਰਾਣੀ ॥੧॥ ਰਹਾਉ ॥ The mortal has come to hear and utter Bani. Forgetting the Name thou attached thyself to other desires. Vain is thy life, O mortal. Pause. p1219 Are there any house manuals that say to read and sing the house manual?
    • All of these are suppositions, bro. Linguists know that, generally, all the social classes of a physical area speak the same language, though some classes may use more advanced vocabulary. I'm talking about the syntax. That is, unless the King is an invader, which Porus was not. When you say Punjabi wasn't very evolved, what do you mean? The syntax must have been roughly the same. As for vocabulary, do you really think Punjabis at the time did nothing more than grunt to express their thoughts? That they had no shades of meaning? Such as hot/cold, red/yellow/blue, angry/sweet/loving/sad, etc? Why must we always have an inferiority complex?

    • There was a young Singh from abroad who went to Anandpur Sahib Hola and got into a fight with some Punjabis who were playing loud non-religious music. He had bana and a weapon or two.
