The Supreme Court today acquitted two Punjab “militants” sentenced to life imprisonment in a TADA case for the alleged murder of a son of the then Ludhiana city DSP in 1986 when the state was witnessing the worst form of terrorism.

Allowing the appeal of Daljit Singh Bittoo and Gursharan Singh Gama, considered to be the activists of All-India Sikh Students Federation (AISSF), a Bench of Mr Justice B.N. Agrawal and Mr Justice A.K. Mathur said that prosecution evidence against the accused was not sufficient to convict them.

Daljit Singh and Gursharan were found guilty by a special TADA court in Ludhiana of gunning down Ashok Bedi, son of the then Ludhiana city DSP in a judgement passed in June 2004 and sentenced to life imprisonment.

Accepting the arguments of senior advocate Sushil Kumar, appearing for the accused, that prosecution witnesses had not supported its case, the apex court ordered their immediate release from jail.

The duo were arrested by the police in 1994, eight years after the crime. Daljit Singh now claims himself to be the president of Shiromani Khalsa Dal.

Counsel of the accused claimed that they were falsely implicated by the police due to the DSP allegedly having enmity with them and consequently the charges under TADA were slapped on them.

The apex court also found a serious legal flaw in the prosecution case that the police had recorded their confession under the amended 1987 TADA, under which it was not admissible as evidence against the accused even as the offence was committed when the pre-amended Act of 1985 was in force.

The recent marriage of Daljit Singh, while on parole, had hit the headlines because a girl had chosen to marry a militant sentenced to life imprisonment.

Cong, SAD two sides of coin, says Bittu

Acquittal of Khalistani proponent and president of the Shiromani Khalsa Dal (SKD) Daljit Singh Bittu by the Supreme Court in a murder case has added new dimension to the Sikh politics of the state.

A former chief of the Sikh Students Federation was named one of the accused in gunning down a son of then DSP Raj Kishen Bedi on June 10, 1986, in Ludhiana. Of the 21 criminal cases registered against him, he has been acquited in all cases save the Rs 5.70 crore PNB dacoity in which he has already been granted bail.

Now he will be free to indulge in activities of his party and is likely to devote his energies to counter anti -Sikh policies being pursued by the Shiromani Akali Dal (Badal).

Talking to The Tribune on phone from Delhi, his counsel, Sushil Kumar, said the apex court had allowed his argument that the confession of Bittu was not admissible as evidence under the old TADA. The police had taken Bittu’s confession under the old one, was wrong. Similarly, witnesses in the case were not reliable and had deposed that Bittu was not present on the spot on that day, he pointed out.

Political pundits are of the view that after reportedly poor show of the SAD during the Assembly debate on terrorism, the release of educated and soft spoken Khalistani proponent is likely to result in new permutations and combinations, a development which is bound to give sleepless nights to SAD leaders. Whether radical groups would rally around him is to be watched.

Another question is will Bittu be able to succeed where other leaders of the Khalistani movement had failed. He has his task cut out for him as youngsters have grown up without a role model and politics of pelf and power for sycophants is well entrenched, they point out.

During his parole a fortnight ago, Bittu had remarked that the debate on terrorism was a farce since the Congress and the SAD were two sides of the same coin. Only they could shed light on who was responsible for turning villages of Punjab into killing fields, he had remarked.

When the news was conveyed to his aged parents, Dr Ajit Singh Sidhu and Palwinder Kaur, thanked the Almighty and reiterated that their son had been framed by the police. All along we had been saying that he was not guilty of any wrong-doing, a stand which has been vindicated by the SC’s decision, they added.

A senior leader of the SKD, Mr Surinderpal Singh, said the time had come for the Sikhs to honour those who laid down their lives for the ‘chardi kala’ of the Panth. It was the time to kick out the pygmies masquerading as Panthic leaders who are more interested in filling their pockets by subverting verdict of the people. The cause of the Panth has been repeatedly sacrificed at the altar of political exigencies,” he added.

Referring to the Parkash Singh Badal brand of politics, he said, “Who had raised voice for the rights of the Sikhs and their hopes and aspirations”?

    • The Mind is Jyot Saroop (Waheguru), but the mind is under the influence of five evils… Through Naam Simran( Rememberance), the mind will begin to detach from evil, and get back to its original form ( MANN TU JYOT SAROOP HEH)… Until the mind breaks free from the five evils, one will go through the cycle of paap and punn….which leads to Karma… Naam Simran destroys past karma, and prevents new karma coming into fruition… I did this, I did that… This non realisation of the Jyot Saroop gives rise to paap and Punn, which in turn gives birth to suffering and misery…
    • I agree we're not born with sin like the Christians think. Also I agree we have effects of karma. But Gurbani does state that the body contains both sin and charity (goodness): ਕਾਇਆ ਅੰਦਰਿ ਪਾਪੁ ਪੁੰਨੁ ਦੁਇ ਭਾਈ ॥ Within the body are the two brothers sin and virtue. p126 Actually, we do need to be saved. Gurbani calls this "udhaar" (uplift). Without Satguru, souls are liable to spiritual death: ਜਿਨਾ ਸਤਿਗੁਰੁ ਪੁਰਖੁ ਨ ਭੇਟਿਓ ਸੇ ਭਾਗਹੀਣ ਵਸਿ ਕਾਲ ॥ p40 Those who have not met Satguru Purakh are unfortunate and liable to death. So, yeah, we do need to be saved, and Guru ji does the saving. The reason Satguru is the one to save is because God has given Satguru the "key" (kunji): ਸਤਿਗੁਰ ਹਥਿ ਕੁੰਜੀ ਹੋਰਤੁ ਦਰੁ ਖੁਲੈ ਨਾਹੀ ਗੁਰੁ ਪੂਰੈ ਭਾਗਿ ਮਿਲਾਵਣਿਆ ॥੭॥ In the True Guru's hand is the key. None else can open the door. By perfect good fortune the Guru is met. p124
    • That's unfortunate to hear. Could you give any more information? Who was this "baba"? He just disappeared with people's money? Obviously, you should donate your money to known institutions or poor people that you can verify the need of through friends and family in Punjab.
    • Sangat ji,  I know a family who went Sevewal to do seva sometimes end of 2019. They returned last year in great dismay and heart broken.  To repent for their mistakes they approached panj pyaare. The Panj gave them their punishment / order to how t make it up which, with Kirpa, they fulfilled.  They were listening to a fake Baba who, in the end, took all the "Donations " and fled sometime over a year ago. For nearly 4 years this family (who are great Gursikhs once u get to know them) wasted time and effort for this fake Baba. NOT ONLY this one fam. But many, many did worldwide and they took their fam to do seva, in village Sevewal, city Jaitho in Punjab. In the end many families lost money in thousands being behind this Baba. The family, on return, had to get in touch with all the participants and told them to stop.  I am stating this here to create awareness and we need to learn from whom we follow and believe. It's no easy but if we follow the 3 S (Sangat, Simran and Seva) we will be shown the light. As I am writing this the family in question have been doing the same since 2008 onwards and they fell for this Baba... it is unbelievable and shocking.  This am writing in a nutshell as am at work on my break so not lengthy but it deserves a great length.  Especially the family in question, who shed light on youngsters about Sikhi 20 plus years!!
