A man was sentenced today to life imprisonment for burning alive four persons in Trilokpuri area of East Delhi during the 1984 anti-Sikh riots which had broken out here following the assassination of the then Prime Minister Indira Gandhi.

Additional Sessions Judge P S Teji also imposed a fine of Rs 30,000 on convict Mahesh saying the prosecution has established he was present in the mob which had set the house on fire resulting in the four deaths on November 3, 1984.

"The prosecution has successfully established on record beyond reasonable doubt that the accused was a member of the unlawful assembly at the time of commission of the offence and entered into the house.

"Prosecution has also successfully established that after entering the house, being a member of the unlawful assembly, accused Mahesh committed the murder of the four persons," the court said.

Mahesh was in the mob which had entered complainant Vidya Kaur's house in block number-13, Trilokpuri on November 3, 1984, and burnt alive her husband Jaswant Singh, his nephew Anokha Singh, his friend Satnam Singh and neighbour Bhajan Singh.

The court relied on testimonies of Vidya, her two sons Surjeet Singh and Kuldeep Singh, who had also witnessed the killings.

"The presence of the eye witnesses has not been questioned by the defence. Rather, the case of the defence was that Vidya became unconscious and was not in a position to identify whereas this fact has been categorically denied by Vidya. As a result, the prosecution has successfully established the presence of eyewitnesses at the spot of the incident," the court noted.

Mahesh had contended he used to visit the house of the complainant to take liquor. He said he was falsely implicated in the case as some altercations had taken place between him and Vidya's husband.

The court, however, rejected Mahesh's contention saying his pleas were "contradictory".

"The defence taken by the accused has been false and contradictory to his various other pleas, particularly when the circumstances of presence of the accused at the spot, presence of eyewitnesses at the spot of riots and murder of the deceased have been established by the prosecution by leading evidence before the court," the ASJ said.

Mahesh was convicted in the case for the second time as the Delhi High Court, on an appeal by him against his conviction earlier, had remanded the matter back to the trial court with a direction to hear it afresh.

Mahesh was convicted and sentenced to life term earlier in January 1997 in the case along with one Baleshwar who died later. Two other accused Mange Ram and Amir Khan were acquitted during the trial.

The First Information Report in the case had been registered on Justice Ranganath Mishra Commission's recommendations.

Following her failure in getting to registered the case of her husband's killing, Vidya had approached the Commission, and had told it in affidavit that her husband, who was working with the DESU, and others were attacked by a mob of around 1,000 on the morning of November 3, 1984.

The mob had looted her belongings and set her house ablaze in which four persons were burnt alive, she had said in the affidavit.

The eyewitnesses had deposed that Mahesh had a knife in his hand.

Considering the deposition by eyewitnesses as "natural, reliable and trustworthy", the court convicted Mahesh saying that "from the testimony of the complainant and other eye witnesses, the prosecution has successfully established that Mahesh actively participated in riots on the day of the incident."

4 out of 4000 victims recieve justice. Impressive figures by the Indian Judiciary, NOT!

Who told it was 4000? 3000 is the official figure in Delhi alone, unofficial in Delhi goes upto 10K+. Add to it, Hondh-Chillar and 100s of such Hondh-Chillar's/Jharkhand/West-Bengal/Kanpur/Nagpur/Lucknow etc. etc. The figure will easily surpass 50,000.

Also, this man is a small implementor and may be he might even be innocent, who will bring the designers/architects to book?

Exactly. Whilst the "little people" who were whipped into a frenzy in order to carry out these massacres should be punished, the architects of these atrocities are still at large. In fact, these orchestrators are laughing at justice.

    • Net pay after taxes. If you don't agree, think about this: If you were a trader and started off in China with silk that cost 100 rupees and came to India, and you had to pay total 800 rupees taxes at every small kingdom along the way, and then sold your goods for 1000 rupees, you'd have 100 rupees left, right? If your daswandh is on the gross, that's 100 rupees, meaning you have nothing left. Obviously, you owe only 10% of 100, not 10% of 1000. No, it's 10% before bills and other expenses. These expenses are not your expenses to earn money. They are consumption. If you are a business owner, you take out all expenses, including rent, shop electricity, cost of goods sold, advertising, and government taxes. Whatever is left is your profit and you owe 10% of that.  If you are an employee, you are also entitled to deduct the cost of earning money. That would be government taxes. Everything else is consumption.
    • No, bro, it's simply not true that no one talks about Simran. Where did you hear that? Swingdon? The entire Sikh world talks about doing Simran, whether it's Maskeen ji, Giani Pinderpal Singh, Giani Kulwant Singh Jawaddi, or Sants. So what are you talking about? Agreed. Agreed. Well, if every bani were exactly the same, then why would Guru ji even write anything after writing Japji Sahib? We should all enjoy all the banis. No, Gurbani tells you to do Simran, but it's not just "the manual". Gurbani itself also has cleansing powers. I'm not saying not to do Simran. Do it. But Gurbani is not merely "the manual". Reading and singing Gurbani is spiritually helpful: ਪ੍ਰਭ ਬਾਣੀ ਸਬਦੁ ਸੁਭਾਖਿਆ ॥  ਗਾਵਹੁ ਸੁਣਹੁ ਪੜਹੁ ਨਿਤ ਭਾਈ ਗੁਰ ਪੂਰੈ ਤੂ ਰਾਖਿਆ ॥ ਰਹਾਉ ॥ The Lord's Bani and the words are the best utterances. Ever sing hear and recite them, O brother and the Perfect Guru shall save thee. Pause. p611 Here Guru ji shows the importance of both Bani and Naam: ਆਇਓ ਸੁਨਨ ਪੜਨ ਕਉ ਬਾਣੀ ॥ ਨਾਮੁ ਵਿਸਾਰਿ ਲਗਹਿ ਅਨ ਲਾਲਚਿ ਬਿਰਥਾ ਜਨਮੁ ਪਰਾਣੀ ॥੧॥ ਰਹਾਉ ॥ The mortal has come to hear and utter Bani. Forgetting the Name thou attached thyself to other desires. Vain is thy life, O mortal. Pause. p1219 Are there any house manuals that say to read and sing the house manual?
    • All of these are suppositions, bro. Linguists know that, generally, all the social classes of a physical area speak the same language, though some classes may use more advanced vocabulary. I'm talking about the syntax. That is, unless the King is an invader, which Porus was not. When you say Punjabi wasn't very evolved, what do you mean? The syntax must have been roughly the same. As for vocabulary, do you really think Punjabis at the time did nothing more than grunt to express their thoughts? That they had no shades of meaning? Such as hot/cold, red/yellow/blue, angry/sweet/loving/sad, etc? Why must we always have an inferiority complex?
    • I still think about that incident now and then, just haven't heard any developments regarding what happened, just like so many other things that have happened in Panjab!
    • There was a young Singh from abroad who went to Anandpur Sahib Hola and got into a fight with some Punjabis who were playing loud non-religious music. He had bana and a weapon or two. There were more of them than him.  He ended up losing his life. Don't be like that. Not worth it to fight manmukhs. @californiasardar1 ਮੂਰਖੈ ਨਾਲਿ ਨ ਲੁਝੀਐ ॥੧੯॥ Argue not with a fool. p473
