Royal Sikh Heiress Wins Battle over 3-Billion-Dollar Maharaja's Estate

SHAILEE DOGRA

After 23 years of legal battle, at last the daughters of the erstwhile Maharaja of the Sikh Kingdom of Faridkot, Harinder Singh, will inherit his huge property, as the court ruled that the will entitling a trust as its caretaker was forged.

Chief Judicial Magistrate, Rajnish Kumar Sharma, pronounced the order on Thursday, July 25, 2013, based on a petition from Amrit Kaur, eldest daughter of Maharaja Harinder Singh, challenge to the will.

The ruling declaring the will “forged and fabricated” brings Amrit Kaur and her sister, Deepinder Kaur, the estate and assets worth Rs. 20,000 crore [equivalent to over US$ 3.33 billion].

The court declared that the will forged on June 1, 1982, was “illegal and void”, and with the order, the trust had also become “illegal”.

Of the Maharaja’s three daughters, Amrit Kaur settled in Sector 10, Chandigarh; Deepinder Kaur moved to Kolkata, and Maheepinder Kaur died some years ago in Shimla under mysterious circumstances.

In 1981, when the will was forged, the ruler was in depression because of the death of Tikka Harmohinder Singh, his only son.

On June 1, 1982, his servants, in connivance with some unscrupulous people and lawyers, forged the will, and the family -- including the Maharaja’s wife and mother (alive then) -- remained unaware of the creation of the forged document.

Executed after about eight months of Tikka’s death, the will raised Meharwal Khewaji Trust and made all the Maharaja’s servants and lawyers, besides some other people, trustees.

The younger daughter, Deepinder Kaur, was appointed trust chairman on the meagre salary of Rs. 1,200 a month (US $ 20); and Maheepinder Kaur was appointed vice-chairman and given a pay of Rs. 1,000 a month.

The document divested Amrit Kaur of all powers of heiress, stating that she had married against the Maharaja’s wishes.

The will came to light in 1989 after the erstwhile ruler’s death. In 1992, Amrit Kaur filed a suit that her father had never made any will and she had remained with him till his death.

WILL’S SECRET

When the will was forged, Raja Harinder Singh was in depression because of the death of his son. The will, if genuine, could only have been created under influence and pressure.

The suspicion arose as the will purported that the Maharaja had excluded his wife, Narinder Kaur, as well as his mother, Mohinder Kaur, and appointed all employees, irrespective of class and designation, trustees.

THE LONG BATTLE

The 23-year-long fight for the royal inheritance could easily be among one of the longest battles in the legal history of this region.

But the wait was worth it for the Maharaja’s daughter who had challenged the “will” entitling a trust as caretaker of the royal assets including forts, palatial houses, hundreds of acre of prime land, heritage jewelry, vintage cars and a hefty bank balance.

At stake were properties worth a whopping US $ 3.33 billion which the Maharaja of Faridkot was allowed to keep after independence.

GENESIS OF THE DISPUTE

Maharaja Harinder Singh, crowned at the age of three in 1918, was the last ruler of the Faridkot estate and was married to Narinder Kaur. The royal couple had three daughters, Amrit Kaur, Deepinder Kaur and Maheepinder Kaur and one son, Tikka Harmohinder Singh. His son died in a road accident in 1981.

WHO FILED THE CASE?

Amrit Kaur, settled in Chandigarh, filed a civil suit in the local district court, challenging the will. Her contention was that her father could not have legally bequeathed his entire estate to the trust because it was ancestral property governed by the law. She also questioned the authenticity of the will with the following arguments:

· The Maharaja was not in a fit state of mind and the alleged will was created under influence and pressure
· Exclusion of his wife, Narinder Kaur and mother, Mohinder Kaur
· Appointment of all the employees, irrespective of their class and designation, as trustees
· Will is invalid, as one of the attesting witness, namely, Brijinder Singh Brar, is a beneficiary himself.

WHAT WAS AT STAKE?

The royal riches include heritage properties and prime land in four states (Punjab, Himachal Pradesh, Delhi and Haryana) and the union territory of Chandigarh. Here is a list of movable and immovable properties which the daughters have won back:

Rajmahal, Faridkot: Spread over 14 acres, it was constructed in 1885 as the royal residence. Now, a 150-bed charitable hospital stands on a portion of palace grounds.

Qila Mubarak, Faridkot: Built by Raja Mokulsi and reconstructed by Raja Hamir Singh around 1775, it is spread over 10 acres. The present main building was built around 1890.

Faridkot House, New Delhi: Located on a huge piece of prime land on Copernicus Marg, it is currently leased to Central government at a monthly rent of Rs. 1.75 million. Valued at Rs. 12 billion nine years ago. Also, there is one more property in posh Diplomatic Enclave.

Manimajra Fort, Chandigarh: Spread over spread four acres, it is at least 350-years-old. The city administration had planned to develop the fort as tourist destination. Decision deferred due to the legal battle.

Faridkot House, Mashobra (Shimla): a 260 bigha estate, it had five residences, three of which, including the Sherwood House, were destroyed in a fire.

18 vintage cars: A 1929 model Royal Royce, 1929 model Graham, 1940 model Bentley, Jaguar, Damler, Packard among others and all of them in working condition.

Aerodrome, Faridkot: Used by the civil administration and army, it is spread over 200 acres.

Gold and jewels: Valued at Rs. 10 billion, these are in Standard Chartered Bank custody in Mumbai.

THE JUDGEMENT

Chief Judicial Magistrate, Rajnish Kumar Sharma, ruled that the will making the trust owner of the property was forged. It has been declared “illegal and void”.

WHAT NEXT

The Chandigarh court judgment may be challenged in the higher court by the Meharwal Khewaji Trust, which has been the custodian of the Maharaja's properties/assets so far.

However, Lalit Mohan Gupta, chief executive officer of the trust, declined to comment on the future course of action, saying he was yet to receive copy of the court order.

This shows that how sikh royals (Sikhs in name only) got regularly duped by treacherous servants and officers mostly belonging to one certain religion. Though we cannot judge whole religion because of them but history shows that we lost most of our freedom because of dogras and above such evil naamak-haram ppl.

our rajas were throwing money around, drinking heavily, sniffing drugs and marrying dozen kuriyaan. If they had bit of good character and follows sikhi, Punjab would have been a much better place.

Personally I think the "Sikh" former maharajah's and their heirs deserve to have every penny ....every rupee taken off them and donated to the shaheeds of the Sikh kaum. These so called maharajah's and their offsprings like captain amrinder singh of the congress party have done nothing for the Sikh kaum since the founding of the Indian union in 1947. They had a chance to create a khalistan/sikhistan as a counter buffer nation state to pakistan and indian but chose to side with the congress leaders and join the indian union of states in the process losing all their power and their kingdoms and having to surviver like a begger at the door of the other "elites" in new delhi laal qilla. How foolishly they were and how they made the Sikh kaum suffer and did not help 1 inch for the Sikh nation to get out of the indian union either through politics or legitimate armed struggle.

So whether their property's and mansions or palaces and land is back in "Sikh" hands in regards to their heirs makes no difference to us because these leeches have forgotten their faith and roots they rather live out their lives in luxury and comfort at the expense of their fellow Sikh adherents ...they have not taken heed what the message of the Guru's is and like karma they need to reap what they sow.

Who cares? These so called raja's have no place or influence in todays society.........kings of the past nobody cares and hardly anybody remembers there names even. They have mostly all re-incarnated and are the modern day Punjab gov't.....Badal, majithitia, chandumajra, etc,etc in past lives were all the same people doing the same gandh.....also politics is a very scary game..we as the common man don't see things from the perspective of politicians who see a bigger picture. We are a minority in India and if the hindu majority pounces on us even once our numbers will decrease very fast, so to some extent one has to play a game.When we are in majority who knows our people may do the same things as the hindu majority does now. The biggest problem is that Sikhs don't trust Sikhs....our biggest weakness and we fall everytime. The world is a cycle the bad will win for sometime then the good will win for sometime, and the cycle continues. Look at history of the world everybody has there day in power both good and bad.

True. these Sikh Maharajas had a golden opportunity to come together and create a Sikh Raaj back in 1947. Instead they made the same mistake the Akali Dal did and joined the Indian union. The Patiala Maharaja(Yajwinder Singh) was the biggest id.iot of them all. He had such power yet he didn't do anything. Of all the Sikh Maharajas he had the most influence over the British. He was even the leader of the chamber of princes, had the most powerful army of all the Maharajas of India comprised of battle hardened WW2 Sikh soldiers. It was his army which stopped the Pak/trible army dead in their tracks from swallowing up the rest of J&K state before the main body of the Indian army even reached there. These Sikh maharajas even after partition became the most loyal followers of the congress party which had done so much wrong to the Sikh Panth.

The present alternative is India and Pakistan which is more than any mess we would have created. There was full scope for a Sikh nation in 47 if Sikhs would have been smarter. Why do you think Punjab was partitioned in the first place? it was because of Sikh pressure to partition Punjab if Pakistan is created and take our share of land and merge it with India instead of Pakistan. Punjab's partition had happened because of the Muslim demand of India's partition. Muslims thought since they were the majority of Punjab, they will get whole of Punjab state. This alarmed Sikh leaders who thought if India is to be partitioned then so must Punjab since living in a Muslim dominated state would have been a disaster(as we later saw what happened to Bangalis and now is happening to the Balochis). But had Sikhs (akali dal and Sikh Maharajas) been smart we could have had political independence. Sikhs had the political power and influance, military might. Sikhs overwhelmingly dominated the Indian military back then. All the Sikh Maharajas had strong Sikh armies of their own. Only thing lacking was a good Sikh leader like Sant Jarnail Singh Bhindranwale who would have seen the danger of merging with India instead of having safety checks intact to insure political independence of the Sikhs.

Sant ji had to deal with such fool leaders we have and Sant ji was true to his heart for the betterment of our people. It wouldn't have amade a diiference if sant ji was there back then as the idiots out numbered the good people. What you say is true, but I was talking from point of view of the advantages we had that we failed to put in use when we had them. After 1947 we lost all those advantages. The Muslims got Pakistan(which included Bangladesh), Hindus got India and the Sikhs who were the 3rd party got nothing, and we also lost our advantages in the process. Sant Jarnail Singh Jee Bhindranwale has said in one of this speeches that if Khalistan(Sikh Raaj) was given to us this time we would not refuse it.

Right now so much Paap in accumulating that Dharti cannot support it's weight anymore. Sikhs have lost all sense of Dharm. Never in history have our leaders been this corrupt as they are now. Our so called scholars are doubting Dasam Bani and other genuine Khalsa traditions, our Sants act less as Sants and more as "Gurus". The average Sikh is drowned in apostasy, drugs, alcoholism and Bhangra culture. All fear of Vaheguru has vanished. We are in a desperate situation now. Only Vaheguru can save us and listen to our pukaar. May He send us some real Mahapursh Gursikhs to guide us on the Guru's Path.

you have a point they didnt trust each other but the bigger mess was the punjab partition and genocide of Sikhs and loss of very important historical shrines and gurdwara's in newly created pakistan. Creation of Pakistan and Indian Union has been the biggest disaster for the Sikh community since the rule of the mughual islamic nutjob aurangzeb and buddies.

So your central point is invalid by the course of recent historical events. Sikhistan / Khalistan was a viable option had the selfish moronic Sikh maharajah's saw what was good for them in the long term, their Sikh faith and community but unfortunately they didnt. So like selfish dogs they chose to trust the brutal oppressive white british administrators of the empire (who did not want smaller kingdoms to remain for economic trading reasons) and the congress brahminwad hindustani atheist india nationalists.
