SC refuses clemency for Balwant Singh Rajoana

New Delhi: In a major blow to the Punjab government, the Supreme Court refused on Friday to give clemency to the convicted Beant's Singh killer is to be hanged on Mar 31.

This decision may trigger violence in the region. Yesterday, the protests in lieu to Balwant Singh Rajoana's clemency turned ugly after an individual was killed and another injured in police firing on Thursday. The two groups clashed over clemency for Rajoana, a convict in the assassination case of former Chief Minister Beant Singh.

Prohibitory orders were clamped and police and paramilitary forces personnel conducted flag marches in parts of Punjab which was on high alert after a Chandigarh court ordered that Balwant Singh Rajoana, convicted in Beant Singh killing, be hanged as scheduled on March 31.

Beant Singh assassination: SC refuses to take up clemency plea on behalf of Rajoana

New Delhi: The Supreme Court on Friday refused to pass any order on a plea for clemency to Balwant Singh Rajoana, awarded death penalty for assassination of former Punjab Chief Minister Beant Singh. A bench of justices TS Thakur and Gyan Sudha Misra said it cannot pass any direction as the convict has not filed any petition before it and the petitioner Abhinav Ramakrishna has no locus standi to plead on his behalf.

The apex court also allowed an NGO, Lawyers for Human Rights International, to withdraw its petition filed with a similar plea. The bench told Abhinav Ramakrishna, an advocate, that since petition was filed under Article 32, it cannot be entertained as in no way, any fundamental right of the petitioner was violated.

In other words, the bench said, Article 32 provision could be invoked only by a person whose fundamental right is violated.

The hanging should not be going ahead tomorrow as per the centre's stay orders which state,

"The home ministry said in a letter that Rajoana's hanging had been "stayed" till the Supreme Court decides on his co-accused, Jagtar Singh Hawara and Lakhwinder Singh's appeals, or the President's order on the petition -whichever comes later."

As per the press release of Press Information Bureau of Government Of India.....http://pib.nic.in/newsite/erelease.aspx?relid=81875..... the death sentence of Balwant Singh Rajoana has been temporarily stayed till the matter is decided by the President Of India on representations filed by SGPC and DSGPC for commutation of death sentence of Balwant Singh.

We have to go a long way to save Balwant Singh Rajoana from being hanged and tomorrow even Jagtar Singh Hawara can be sentenced to death, since CBI has appealed against the judgment of his sentence being reduced to life imprisonment by Punjab & Haryana high court.

So we can rest for some time and recoup our energies, but the battle has as yet not been won. We must ensure that no body should be given Death Penalty as it is inhuman to kill someone through Death Penalty. We must ensure that India becomes a Death Penalty free country and adopts alternative forms of punishment.

Fact: President can make decision anytime and officials have to follow her decision. So it is really upto her

Personally, I and everyone in punjab do not think she gonna give any further order on this case for the next few weeks or even months/years.

We should not lose our momentum. Keep protesting, get in touch with your govt. reps, and keep creating awareness of the issue. We need to get the word out that Punjab police are killing peaceful protestors. We need some pics, video, etc from our brothers and sisters in Punjab, in order to do this.
