WHY: READ BELOW

A group of members of this Sabha raised written concerns of malpractices and procedural improprietory conduct of the out going (2004) executive committee to gain unfair advantage over others in the conduct of issuing membership and elections and other grave irresponsible behaviour and non existence of very important information and documents or controls in the course of managing the affairs of the Sri Guru Singh Sabha, Southall- A Sikh public institution having £3 MILLION annual income. THEIR REPLY: ‘ your concerns are only of a general nature’

Upon further pressure the ‘Trustees’ invited two representatives of these members to a meeting with them, the General Secretary, Mr GARCHA and The President, Mr SOHI to discuss their grievances.

This meeting was attended, in good faith, by two of the enquirers, as mutually arranged and agreed at 5pm FRIDAY 24th September 04, but on arrival at Park Avenue Gurdwara offices, the enquirers were was told that the meeting CANNOT take place, even though Committee heads, Mr SOHI and Dr GARCHA, plus TWO TRUSTEES, Mr AS Sevak and Mr SS Bilga, were present as agreed by both sides.

The heads of the temple said that they were not willing to talk to anyone on the issues raised, even though the agenda, for this meeting, had been agreed with them 2 days earlier. The enquires, however, persisted to put some questions to the president and the general secretary, Messrs Sohi, Garcha:

Q. The CONSTITUTION states that the 2nd AGM should be in AUGUST?

Their Reply: ‘We arranged it as we saw fit’

Q. In the UK a person can get a passport, Driving Licence and arrange virtually all their affairs by post or the Internet. Many Sikhs who want to be members of this Sikh temple cannot travel because of sickness, disability or lack of transport. Why do you not offer postal membership applications?

Answer. We decide how a person becomes a member.

Q. Why do you not allow people to become members all the year round?

A. Why should we?

Q. Why do you make difficult for people to join as members, is it so that you can

engineer the election results in your favour?

A. We don’t know what you mean?

Q. Your decision is discriminatory and limits the number of members that can join and this gives your illegitimate votes and family votes a greater percentage of total so that you can win the elections and keep control of Gurdwara money. Is this why you do this?

A. No answer.

Q. WHY have you arranged the AGM 5DAYS before the ELECTION, when it should be 42 days before? Their Reply: ‘ we arranged it as we saw fit’

Q. Do you accept your duty to inform the SANGAT of all the affairs of Sri Guru Singh Sabha? Reply: ‘ we do as we see fit’

Q. Do you not think that the SANGAT (temple congregation) needs time to assess your performance on the ‘facts’ that you present in the AGM? Reply: as above.

Q. This mounts to a deliberate deception of the Sikh Sangat, does it not?

A. That’s your opinion

Q. As per the CONSTITUTION The AGM scheduled for 26th September 04 is ILLEGAL as upon declaration of Election which should be in AUGUST AGM the Executive committee should be dissolved. Is it not your responsibility to abide by the law? Reply: ‘Its irrelevant, we do as we see fit and there is nothing you can do to stop us doing as we please, we do not want to talk to you any more’

Please note that the usual opposition group to the sitting committee had boycotted the election process due to the unfairness and cheating practiced by the later.

On 26th September 04 about 10 members of the Gurdwara held a peaceful boycott of the illegal AGM outside the Park Avenue Gurdwara and were distributing leaflets outlining matters of concerns about management of the Gurdwara and demanding fair and just democratic process to choose the people to manage the temple.

The temple president,SOHI, his brother and two sons, in full view of his committee members and other Sikhs numbering over 200, attacked the peaceful protestors causing serious injury to them and 4/5 persons required hospital treatment. Serious threats of more violence were made against anyone who dared to question the president and his CONTROL of the Sikh Temple. (Park Avenue and Havelock Road SOUTHALL)

The aggressors all lied in court under oath to the Gurbani and they got their paid cronies and relatives to come and do the same. No committee member, even having seen everything, gave witness statements to police or court – is this an example of Sikh gallantry? NO, It’s shameful. One Committee member later gave written and signed account of seeing the president of the temple, his brother and sons attacking, hitting and kicking the peaceful protestors: He later refused to say this in court (His written statement is available but due to evidence laws it could not be produced in court hearing)

Mr SS Sangha gave witness statement in favour of Himat Sohi, the president and main person accused. It should be noted that Mr Sangha did not respond to any police appeals for witnesses or appeals in Punjabi papers by the victims. At the trial 15 months after the incident and after all prosecution witness statements,

Mr Sangha suddenly and miraculously remembers incident details and his duty to give evidence. Mr Sangha is a Justice of Peace (JP) fully aware of his duties to help the law. His statement was utter lies given on oath to the Sikh Scriptures.

PLEASE NOTE Mr SANGHA was, and still is, engaged, by the committee, as a consultant to the Gurdwara and is a paid cash benefit ranging £2000 t0 £4000 per month. Therefore he was fully aware of the police and other appeals for witnesses as he claims to have seen everything. He must have seen Police attending the disturbances and knew of the Police investigations into the incident. In his statement he does not declare any conflict of interest or vested interests. IS THIS AN ENGINEERED ACTIVITY TO UNDERMINE THE CASE OF TRUTH.

CCTV system recording was destroyed. Dr Garcha lied to police that system was out of order (Letter of proof from the claimed maintenance company available but not admissible in court as writer was unwilling to appear at court).

Dr Garcha claims to be neutral in this matter? Criminals got away scot-free!!!!!!!!!!!!.

Their victims and their witnesses were ridiculed and later expelled from the membership of the temple and remain expelled to this day.

This is an evil manipulation of the situation to avoid the opposition and their questions. The expulsions were timed a day before the 2005 AGM and after questions of the deceptive methods of the committee were again submitted in writing to be raised at the AGM. Dr Garcha and the so-called ‘independent’ committee of the Temple took this action without referring it to the General Body as required by the Constitution. The president claims he had no input in it? It is worth noting that elections are now due again. Is this Sikh justice and democracy in a place of worship?

Dear Sangat Ji: We beg you to think of these questions: Is this the message we want to give to our children? Flout the law in a place of worship and then lie on oath to its Scriptures to escape punishment? Be too scared to give witness to the truth?

IS THIS WHAT Today’s SIKHISM STANDS FOR – Hypocrisy and cowardice?

Remember all the sacrifices given by our Guru’s and forefathers to stand with the truth. Are we true to their teachings? Do we want?

1. Violent and ruthless people looking after our places of worship?

2. People with business deceit judgements against them, controlling and managing Millions of pounds of public money.

3. Criminals who use violence, and then pay cronies and family members to lie in courts and cast illegal votes managing the Sikh places of worship.

4. People who could not be brave enough to perform their Sikh and citizen duty of offering to witness crimes they actually saw, despite Police appeals, to be representing Sikh interests.

Record has shown, over and over again, criminal minds will bring disrepute to our community and do irreparable damage to our Sikh core values of honesty and integrity and many other human qualities preached by our Gurus. The values cherished by all civilised societies around the world.

PLEASE THINK AND MAKE YOUR CHOICE OF RIGHT AND WRONG, as we are all accountable for our decisions, actions or inactions. As Sikhs this is our duty.

Please MAKE a CHANGE before these hypocrites become PERMANENT CONTROLLERS and KEEPERS OF SIKH PUBLIC INSTITUTIONS, built with your hard earned money. Our children will rightly curse us, if we don’t.

For example: New Gurdwara building account was not given until pressure from us and then project costs are given as £13Million approx and the total project costs are given as nearly £19MILLION. It came to our knowledge that £4MILLION was paid in professional fees alone. This 30% of project building costs and 3 TIME MORE THAN Royal Chartered Surveyors guidelines on fees of similar projects. The reasons and final destination of the money is not being revealed.

YOU CAN FIND OUT BY BECOMING MEMBERS, I AM NO LONGER ENTITLED TO ASK QUESTIONS. Please ask:

Who are these ‘professionals’ that your money was paid to and what for? What safe guards were in place to control abuse and malpractice in appointment of them and controls on their costs?

Why detailed accounts are not available even after so many years of completion of Gurdwara?

Why Sangats is being denied their right to know and have independent audit? We undertake to pay the cost of Forensic Accountants to do an INDEPENDENT AUDIT to satisfy the Sangat.

What justification is there for a decision to build this Monumental Gurdwara with so few extra facilities than the old building and yet costing nearly £19MILLION. It is more of a showpiece and ego gratification of the management than serving Sangat. High Cost of having functions – marriages, etc, makes it a Gurdwara just for the rich and ignores the acute needs of the local working class Sikh Sangat. Unwise and inappropriate decision by few but whole Sangat is liable for costs.

Why is the Sangat being kept in the dark and not included in the decision making process? Sikh way is that the Sangat should decide and managements should serve as SEVADARS (servants). This Gurdwara building does not fit the needs of the local community, it was conceived as a ego gratification of the committee members.

Present committee has no answers: our 30 odd letters remain unanswered over the last 3 years dealing with:

TRANSPARENCY AND ACCOUNTABILITY that is the right of the SANGAT.

Information to membership: nil

We wonder why certain important information is only detectable by looking at two different notice boards some distance apart? Is it to CONFUSE PEOPLE?

Why notice of meetings are not properly sent to members. Other Gurdwaras post them. Why member’s questions/queries are not answered in meetings?

Why the executive refuses to answer legitimate questions from the membership?

Constitution, Meetings and Elections

Clause 16 of the CONSTITUTION: Retires the outgoing executive members in the regular AGM that should be in AUGUST and election date should be announced to be held after 42 days of announcement. No AGM should be called during this other than voting.

Membership should be allotted after august AGM in the month of September.

Why supervision of membership process is exclusively under the control of the outgoing executive? This is illegal. All parties have a right to be involved and oversee the membership process with the outgoing Gen Secretary having overall administrative control.

Any meetings after this AUGUST AGM are illegal and the last sentence of Clause 17 is invalid. When was this added and why?

WHY is the 2nd regular AGMs always held in last week of September and ONLY I week prior to election date? THIS IS AN ABUSE OF THE CONSTITUTION

More questions need answers:

Unconstitutional and Illegal Votes? Recent survey of 800 votes revealed 80 illegal votes. The committee has complete control – why do they not let opposition parties also participate in the process?

AMENDMENTS to CONSTITUTION? What, when and why and without General Body approval? Why no accountability is available without expensive and unnecessary legal actions.

ELECTIONS: Methods, Timing, and Fairness. ALL CLOSED SHOP ACTIVITY.

Why all groups are not allowed to have equal role in supervision of these?

Limit length of term in office to enhance more accountability and opportunity for new sevadars. WHY and how THIS LIMIT was DELETED FROM THE CONSTITUTION?

EXPULSION OF MEMBERS: why has the constitution been changed to give all power to committee?

Membership: why people are not encouraged to become members but it is made difficult with limited time windows and cumbersome procedures. WHY NO POSTAL MEMBERSHIP APPLICATION ARE POSSIBLE at any time of the year?

THE ANSWER IS:

LESS MEMBERS MEAN GREATER POSSIBILITY OF WINNING THE BALLOT with the help of family and illegitimate votes to keep control of Sikh assets.

Become a member and help to give true democracy a chance.

Procedures and Bye Laws:

There is very little written down which leads to ambiguity and suspicion as the Sangat experiences conflicting set of arbitrary decisions.

Employees v SEVADAR culture:

More and more engagement of employees erodes the principles of seva in the Sikh way of life and has a negative affect on our faith.

Management should encourage seva activities not negate them with paid employees.

SIKH GURDWARA BELONGS TO THE SANGAT. Then why do we not encourage Sangat’s prominent role in decision making and running its affairs?

The present committee headed by Sohi is guilty of manipulating the rules for political benefit and changing the Constitution without approval from the General Body. This is unlawful and shameful for a Sikh place of worship.

NB: on 16th July 2006 at about 5am the OPPOSITION campaign offices at Monsoon Banqeting Suites were burgled. It should be noted that:

Nothing of value was taken, No money was taken, and

CCTV camera recording shows the culprit clearly going through the desk draws looking for papers and documents.

Opposition group has many sworn statesment from people alleging malpractices and harassment during membership application process.

Naturally, given the past threats and actual violence, we wonder if it’s connected to the Gurdwara politics????????????
