Rights group seeks Modi's prosecution for Gujarat carnage during his visit to Canada, submits Memorandum of Law to Canadian AG

The 16 page Memorandum of Law, submitted to the Canadian AG Peter Mackay, has argued that the Canadian law provides for the prosecution of individuals who commit acts of official torture outside of Canada where, after the commission thereof, they are present in Canada and st ate immunity does not prevent Canadian authorities from charging and trying Modi for torture, and in the group's view, genocide as well .

Filed with the, the complaint alleges that in February-March 2002, Modi aided, abetted and counselled in relation to the massacre of thousands of Muslims in the state of Gujarat, while he was the chief minister.

Drafted by lawyers Marlys Edwardh and Louis Century on behalf of SFJ sets out the factual and legal basis for charges against Modi. The complainant urges the Attorney General to bring charges, or to consent to charges being brought, against Modi for aiding, abetting and counselling torture in violation of section 269.1 of the Criminal Code.

The MoL also urges the Attorney General to bring charges against Modi for counselling genocide in violation of section 6 of the War Crimes and Crimes Against Humanity Actwhich also provides for extra territorial jurisdiction.

Edwardh said, "a senior member of the Indian bar, appointed by the Supreme Court of India as amicus curiae to investigate Modi's role in the violence, concluded that there were sufficient grounds on which to proceed. Translated into Canadian law, there are reasonable and probable grounds to believe that Modi engaged in these crimes. This is sufficient to call for his arrest so that he can stand his trial. Only by taking this step will Canada's commitment to ending impunity for torture and genocide be realized."

It also argues that Supreme Court of Canada had earlier confirmed that the prohibition against torture is a peremptory norm of international law and that it is non-derogable by any state. Canada's criminal law grants universal jurisdiction over official torture when the person who committed the acts of torture is present in Canada.

"Since Modi continues to enjoy impunity in India we are invoking the Canadian law to hold him accountable for gross human rights violations. Unlike India, Canada does not let violence against religious minorities go unpunished," said SFJ legal advisor Gurpatwant Singh Pannun.

It may be mentioned here that SFJ has already announced opposition to Modi's visit to Kanishka Memorial Site on April 15 stating that it would be an blatant attempt to plant in the minds of Canadians that all Sikhs are extremists or terrorists. "We will always mourn for the victims of the Air India bombings, which included Muslim, Hindu, Christian and Sikh families," said Jatinder Singh Grewal, SFJ's Director of International Policy, adding, "we object to the memorial being turned into a political circus".

I cannot see how India is going to be bothered about Canada if Modi has already visited the US and is visiting several countries in Europe.

Although Modi is PM of India, we must remember during the floods in Uttaranchal a few years ago, Modi as CM of Gujerat only worked to rescue his own fellow Gujeratis. It was the likes of Khalsa Aid who went in and provided aid and supplies to villagers trapped by the mountain mud slides.

These are the same Gujeratis who want to kick out the Sikhs from the lands that were acquired decades ago which were barren and the Sikhs helped to make fertile.

Gandhi the so called Gujerati Mahatma who conspired with the British to get rid of Bhagat Singh, this Gujerati also wanted Punjabi and our Gurbani in Devnagari script but never asked the same for his own mother tongue. This is the same Gujerati that left his Gujerat intact whilst our Punjab was broken into two after so much bloodshed. Arya Samaj was started by a Gujerati and they are virulently anti-Sikh. Sardar Patel, the so called iron man of India was also virulently anti Sikh.

The Gujerati Hindu is one of the most hardcore Hindutva but also some of the most adharmic people and also some of the most anti-Sikh people.

Let these hardcore Hindutvas and Islamics duke it out, let us Sikhs keep out of it.

No Sir! If you had read Sikh history, you would know better. Was Sri Guru Teg Bahadur Sahib ji's Shaheedi in vain for the Hindu nation? We had a lot of issues back then as well. Sikhs don't see us and them when it comes to injustices. Sikhs will not die out because we start helping those in need. Neither will we flourish by helping others in need. This is not a game of win or lose, but a game of following Vaheguru's command (no desire). The sooner Sikhs stop practicing the simrtris and shastars, the faster we Sikhs will get back on track and let Gurbani lead the way.

When the Saharanpur riots happened, not a single Gujarati Muslim came forward to condemn this unprovoked attack on Sikhs. I don't mind Sikhs standing up for Kashmiri Muslims and their rights because they also sometimes stand up for Sikhs since they are in the same boat, but the other Indian Muslims are an ungrateful bunch. Take the Saharanpur attack as an example. The Gurdwara committee which owns a school gives free education to poor Muslim girls in that area. Sikhs of that area help Muslims during any natural calamity such as floods and even allow them to do Namaz in their Gurdwara if they need to(which by the way goes against Sikh rehit Maryadha), but some Sikhs being the moorakhs they are allow such blasphemy to take place. Then Sikhs give untold amount of money and food during Eid. Yet still Saharanpur Muslims disregarded all the service that these friendly Sikhs did and attacked the Gudwara even though that land belonged to the Sikhs. And to top is all off, not a single Muslim organisation any where in India stood up for the Sikhs and especially not the Guju Muslims for whom Sikhs always raise their voice.

Sikhs did indeed have issues then, but in those days we also had tons of great leadership, unlike today where we have 0 leadership and 0 unity and are much easier of a target. Exactly what I was saying earlier, we can go around helping everyone possible, pretending everything is fine and dandy, but in the end we get a slap in the face. But it's still not enough for most sikhs to wake up. We need to put the effort elsewhere or else Sikhi will be gone soon.
